This story has several levels of insanity. We have the wasteful spending angle. Then there's this whole transgender, sex change thing. Then there's the criminal element. It has it all. Unfortunately, this isn't some steamy novel, but rather another example of just how stupid government officials can be.
In this case, the "official" is a federal judge, and the criminal is a murderer.
As reported by the Associated Press, Robert Kosilek was convicted of murder when he killed his wife in 1990. He has received hormone injections and now lives as a woman (Michelle Kosilek) in the all-male prison.
Kosilek first sued the Massachusetts Department of Correction 12 years ago. Two years later, U.S. District Judge Mark Wolf ruled that Kosilek was entitled to treatment for gender-identity disorder, but stopped short of ordering surgery. Kosilek sued again in 2005, arguing that the surgery is a medical necessity.
In his ruling Tuesday, Wolf found that surgery is the "only adequate treatment" for Kosilek's "serious medical need."
"The court finds that there is no less intrusive means to correct the prolonged violation of Kosilek's Eighth Amendment right to adequate medical care," Wolf wrote in his 126-page ruling.
So... first Wolf rules that Kosilek can have "treatment" for a "disorder," and now he has taken the next step and ordered the taxpayers to fork over the money for a full-blown sex change operation!
In a report in the Boston Globe, Wolf is quoted from his ruling as stating, "This fact that sex reassignment surgery is for some people medically necessary has recently become more widely recognized."
Medically necessary? Come on! This guy (or girl or it) is crazy or perverted or both, and this judge continues to indulge him (or her or it) at the expense of common sense and the U.S. taxpayer.
So... What happens next? Is he (or she or it) shipped off to a women's prison? This is just nuts... if he has an X and a Y, guess what? He's a guy! Get over it and move on.

What I can’t figure out is why criminals even have the access to the courts and/or can sue in this case. Seems criminals have more rights than honest law abiding citizens and these perverts as judges allow it.

This is pretty bad but how does in compare in our tax dollars to the really rich getting tax cuts that should go into reducing the deficit. Or the rich oil and gas profiteers receiving billions of our tax dollars while making billions in profit. Or some big companies that pay little in Federal taxes and in some cases even though they have made thousands or millions of dollars in profit they have also received taxpayers dollars in refunds. Whether it is Democrats or Republicans, I would rather this be seriously addressed instead of the Ryan budget to cut billions from State funds that likely will require the laying off of firemen, policemen, and teachers among other things.

wathen…how do you like your Kool Aid? There would not be a 16T deficit without comerad obama. Oil companies do not receive any such subsidy but in fact pay billions in taxes. Kool Aid liberals love to tell us how much corps make but never mention what it costs to run their companies. Never! Liberlas never mention the 35% corp tax rate. The Ryan budget will create jobs. Item last, I have a 99 year old aunt. She was getting a reduction in her ConEd bill until recently. I called ConEd. They informed me the reason she no longer gets the cut is because of obamacare. ConEd will no longer subsidize her because the funds which were paying for the subsidy are now going into obama commy health care. Think about it. Maybe you’ll pass on the Kool Aid in November.

There was a day when criminals were punished. What possible difference could it make if a person were to think they were of a different sex? He/she can take care of that when the sentence is served. We need serious legal reform in America!

That might be true, but Reagan had nothing to do with his decision. He was allegedly vetted by the Congress and they confirmed him. There is no way anyone can tell how a judge is going to rule in any given case.

Yes, this judge was appointed during Reagan’s administration; however, it was shortly after he had successfully led an investigation into public corruption and I’m pretty sure that was a factor in his nomination. As for “blaming” Osama does anyone really believe that a judge would have ruled in favor of a sex change operation paid for by taxpayer dollars during President Reagan’s administration? Absolutely NOT! Finally, this judge is in a Massachusetts district. Anyone who studies jurisprudence at all knows that there has been a “liberal triune” for years made up of NY, MA and CA districts. This judge has made several “pro- homosexual” rulings in the past few years – this is not his first (see Parker v. Hurley). I still say “folly, vice and madness” prevail, from the top on down under Osama!

As for paying for some dude’s transexual fantasy / operations, let the low life pay for his own. For that matter the govt. should not be paying for anyone’s sex change operation. They are controversial and there is no proof that they are one type trapped in the body of anther. For all I know they are just very confused people whose mother like to dress them up as dolls….

My Brother in Law was incarcerated for 17 years for a crime and when he was in prison, the prison didn’t pay for ANYTHING, nor did they provide him anything other than the basic needs, food, medical attention when he needed it.
He had a heart condition and the prison gave him only what kept him from dying. He also suffered from seizures and they gave him medicine for that.
His family had to pay for everything that he needed like clothes shoes, etc.
And under “medical attention” they sure would never had provided this kind of surgery even if my BIL had access to a lawyer which he didn’t.

In Oregon some rapist couldn’t be held in jail because he required $100,000.00 in medicine and the sheriff had the choice of firing two deputies or releasing him. Shear absurdity, but this is why we need to return sanity to government and the courts.

I would say that the ‘murderous criminal’ needs to be put on a ‘chain gang’ and worked. Who knows if his chains got wrapped around his gonads and sundry other parts and ripped them off his body; presto, a sex change and all at no expense to the taxpayer. Stranger things have happened in prison.

I think the discussion is dwindling to be uncivil when people became to shift blame on today’s president. It is same divisiveness conservatives are crying about. Remember this Judge was never appointed by obama but Ragan and he is a conservative judge. I think “hatred for this president” is clouding judgement here. The judge who does such “sinful thing” to you should be decried and not the president. another thing to say here is that when we are pointing a finger remember, four others are pointed at us. so the “holier the thou” should continue to cast the stone at the president. We all are paying for the judge’s decision as the same we do in taxes when the big oil companies’ interest are sought more than the common people. I guess if you don’t have any good thing to say about this case it better to keep quiet than to sold sea of discord about the president.

No hatred here. It’s not about blame, whoever appointed this judge. It’s not about the “injustice” of corporations and their supposedly “immoral” profits. This is about a man, convicted of murder who is also a pervert, who now expects the taxpayers to pay for his perversion. Prison is supposed to be for punishment. It is not a country club where everything is free. The outrage is about me, a taxpayer, having to help pay for a ridiculously outrageous request. A sex-change operation is not a “medical necessity”. This judge (whoever appointed him) is seriously in error.

If we were to outsource our “corrections” facilities to Mexico we’d save a zillion dollars on prisoner care. If you don’t want to be a contributing member of our society, go be part of another society for a while. Then come back here for the last three years of your sentence (for good behavior) and the prisons (no longer overcrowded) could spend the time & effort to teach you a real trade (corrections) prior to re-introducing you into society for “round two”.
It is a fact that we spend far more (3x, 5x, 10x … not sure at current) per prisoners than we do per child in the education system. You want to make real changes to the way our country behaves … quit funneling money to those that have chosen to violate against society and re-invest it into those who are the future of our society.
That being said … do you really think that Mexico, Germany, China, England, Japan, Australia, Brazil, etc. would pay for a prisoner to have a sex change … seriously, this is absurd.

Can someone point out where in the 8th Amendment does it refer to medical treatment? Basically, it only has to do with the level of punishment as pertains tot he crime.
Doesn’t say they should have a TV in their cell, or special religious rights, etc.

A comment on Wathen post. Ryan’s budget doesn’t cut one penny from the budget. It cuts projected cost. With the way government set up the budget, every department get an increase over last years budget. Ryan’s budget cuts into this automatic increase.

People are against the death penalty because it is, according to them, a cruel and unusual punishment. True, taking a life is a cruelty, no matter who does it, whether it is some sleaze ball or the government. No argument there. But as for being unusual, not so. Executions have been going on for thousands of years. The complaint is that the execution process is painful. Even though he may have kidnapped, raped, tortured and strangled a fourteen year old girl, heaven forbid that some slime head be inconvenienced when he is being executed. What to do about it? Well, there is a method that would wipe this guy out and he won’t feel a thing. There won’t even be a needle prick in his arm, or tight straps holding him down. And we really don’t even know how much pain is produced by the drugs themselves.
Let’s assume that you have been convicted of some outrageous crime and have been given the death penalty. When the time comes you are escorted into the death chamber and the door is closed behind you. Inside, along with some soft mood lighting, is a lazy boy recliner, a pizza, a can of your favorite beer, maybe even a large TV set. At the proper time someone flips a switch and the air is, very slowly, pumped out of the chamber. When the simulated altitude inside gets up to around thirteen or fourteen thousand feet you black out from lack of oxygen to your brain. The pumping continues until the simulated altitude is up to thirty thousand feet. The pump is shut off and we wait. After about twenty or thirty minutes the air is let back in, the door is opened and they haul your worthless carcass out to the garbage heap. If the pumping is done slow enough your ears won’t even pop.
Easy,
no pain,
no discomfort,
you simply..just…fall….assleeepppp.

Having lived thru the wonderful benefits of Medicaid in Tennessee in the 90′s, I am not surprised. Not only were the uninsured moving here in droves, the “downtrodden transvites” were coming in droves to get their sex changes and life long hormone therapy. We finally got a Republican governor who put a stop to it.

One interesting point I haven’t seen addressed here at all is – that he, when he becomes a she (or it) will no longer be the “name” that committed the crime and will want to be exonerated for said crime. Knowing his luck, he’ll have the same judge (that granted the sex change procedure) and will grant the release since she/(it) is not Robert Kosilek, but Michelle Kosilek and Michelle did not get charged with the murder.

I would say that since this he, she, it killed his wife, that perhaps the only reasonable cure to his, her, it’s dilemma is a quiet interlude with the death chamber of his, her or it’s choosing. The truth of the matter is, no matter what surgery or pills this man takes, he will ALWAYS be a man. Molecularly, he will always be a man because his DNA says so. If he were to be taken off of female hormones, his body would no longer look “female”. To give this idiot surgery is to set a precedent. If this is allowed, there is no telling where this could go. Breast implants for female prisoners? This is absurdity to the nth degree. To foist this onto the taxpayers is absolute insanity.

Why are we suddenly asking how our tax dollars are being used? I think it pretty much started with Senator Coburn, (R-OK). He investigated wasteful spending, reported it and the response was nothing. The media touched on Coburn’s negative look at spending a few times but the new wore off and they were treading in dangerous territory for both parties.
The so-called law makers supposedly work for us but they pay us no mind. Why do they pay us no mind ? We pay them no mind.

In the House of Representatives from 1931 to 2012 – 82 years – 64 of those years were held by Democrats!
78% of that period as opposed to 18 years by Republicans or 22%.
It would seem to me they’ve had more than their share of time to fix anything they felt was wrong.
Especially in 2009 – 2010 when the “chosen one” had a totally Democratic controlled Congress.

If you searched my file, you would know that our family contributes proudly to Republican causes, and has done so since 1980. I am growing disgusted by the ugly language that passes for commentary on this blog. If the Party wants to sponsor the blog, they should monitor it for bigotry and vulgarity and delete all such comments. I am rapidly becoming disgusted with the behavior of people who claim to be on a higher moral plane than the Democrats. In the mean time, folks, could you please monitor yourselves?
