Major requirement of Obamacare delayed until after 2014 election

WASHINGTON - In a major concession to business groups, the Obama administration Tuesday unexpectedly announced a one-year delay, until 2015, in a central requirement of the new health care law that medium and large companies provide coverage for their workers or face fines.

The move sacrificed timely implementation of President Barack Obama's signature legislation but may help the administration politically by blunting a line of attack Republicans were planning to use in next year's congressional elections. The employer requirements are among the most complex parts of the health care law, which is designed to expand coverage for uninsured Americans.

"We have heard concerns about the complexity of the requirements and the need for more time to implement them effectively," Treasury Assistant Secretary Mark Mazur said in a blog post. "We have listened to your feedback and we are taking action."

Business groups were jubilant. "A pleasant surprise," said Randy Johnson, senior vice president of the U.S. Chamber of Commerce. There was no inkling in advance of the administration's action, he said.

Under the law, companies with 50 or more workers must provide affordable coverage to their full-time employees or risk a series of escalating tax penalties if just one worker ends up getting government-subsidized insurance.

Originally, that requirement was supposed to take effect next Jan. 1. Business groups complained since the law passed that the provision was too complicated. For instance, the law created a new definition of full-time workers, those putting in 30 hours or more. But such complaints until now seemed to be going unheeded.

The delay in the employer requirement does not affect the law's requirement that individuals carry health insurance starting next year or face fines. That so-called individual mandate was challenged all the way to the Supreme Court, which ruled last year that requirement was constitutional since the penalty would be collected by the Internal Revenue Service and amounted to a tax.

Tuesday's action is sure to anger liberals and labor groups, but it could provide cover for Democratic candidates in next year's congressional elections.

The move undercuts Republican efforts to make the overhaul and the costs associated with new requirements a major issue in congressional races. Democrats are defending 21 Senate seats to the Republicans' 14, and the GOP had already started to excoriate Senate Democrats who had voted for the health law in 2009.

Senior White House adviser Valerie Jarrett cast the decision as part of an effort to simplify data reporting requirements.

She said since enforcing the coverage mandate is dependent on businesses reporting about their workers' access to insurance, the administration decided to postpone the reporting requirement, and with it, the mandate to provide coverage.

"We have and will continue to make changes as needed," Jarrett wrote in a White House blog post. "In our ongoing discussions with businesses we have heard that you need the time to get this right. We are listening."

Republicans called it a validation of their belief that the law is unworkable and should be repealed.

"Obamacare costs too much and it isn't working the way the administration promised," said Senate Republican leader Mitch McConnell of Kentucky. "The White House seems to slowly be admitting what Americans already know ... that Obamacare needs to be repealed and replaced with common-sense reforms that actually lower costs for Americans."

      The Democrats are predicted to lose seats in both bodies.
      Delaying this implementation may reduce the number of people (Democrat people) who are foaming-at-the-mouth angry at Obama.

      That MAY reduce the losses of Democrat seats.

      This was NO concession this was a very slick political strategy to help elect another Demoncrat and make people think they are being accomodating.       It is estimated that OVER 50% of small businesses will fail once Obamacare is fully implemented unemployment will be over 50% And that’s the low side of the estimate, The democrats know that if when that happens the American people are going to be VERY angry, Elections really do have serious consequences what you going to do about it????

      This delay by the Democrats is a ploy to keep the young voters in line to take over the house in 2014. Curently young voters pay $800/yr out of pocket to cover their less than plethora of medical needs. When Obamacare kicks in they will be forced to pay $5500/yr in insurance premiums or pay the $2000 penalty. No way do the Democrats want the uninformed young voters to find this out before the 2014 election and Beohner should hold their feet to the fire and get it implemented on time.

      There are folks out there that still thinks this is free insurance. When I tell them that it isn’t the case and the law requires them to buy Heath insurance or pay a fine I am called a liar or the best response yet, “That can’t be true you probably heard that on “faux news” and they lie to people”. You can’t fix stupid or inform those who refuse to be informed.

      I’m totally against odumbo care but I’m curious about something. How is it that odumbo can delay the implementation of odumbo care? Is there verbiage in the legislation that allows him to delay implementation or maybe he went to Congress and asked them for Congressional approval to delay implementation? Or is this some unseen presidential power that he thinks he has?

      DealerDeb1 is right, it’s a card trick and an old one at that and anyone who falls for it is a fool. Obama is a slick and savvy Chicago pol who will use every trick there is in the windy city political trickery library to his advantage.     Dumb Question:
    How can a president delay, cancel or modify a law which Congress has passed when his position in the executive branch requires him to carry out the will of Congress?
    obamacare should be flushed in it’s entirity, no delays, no modification, no whim of this illegal president.
    And his political move of after the midterm elections has to be seen as a hope to decieve the voters and then stick it to the country after his hoods get elected. America, don’t fall for this nitwit’s plan.

    Here we go again. Obama poisons the water with the Health Care Reform bill, then when it does not go his way and he fears his tyrannical agenda and scandals will hurt the Dems chances of retaining the senate or winning the house in 2014 he goes without warning or advanced notice and changes the law to better the democratic position for 2014. Its pretty crystal clear what the plan is here. the problem is that he uses his 65 plus million uninformed Obama Kool aid drinking voters, the media and Hollywood to sway the rest of us into thinking this is Ok and the Liberals are all of the sudden on our side and looking out for our best interests.     The Supreme Court said Obamacare is a tax bill. Tax bills, according to the Constitution, are the purview of the Congress, I guess Eecutive Action trumps the Constitution.

    Whether it happens in 2014 or 2015 the outcome will be the same only it will be delayed so it is still a valid talking point. I would be more concerned that somewhere in that delay things will get changed such as lowering the 50 employee threshold to 25 employees or some dimwitted idea like that.

    Personally I think the Democrats are doing a pretty good job of sinking their own ship. People are paying attention now. Too bad they were still sleeping last November but then again maybe not. Give a guy enough rope and eventually they will hang themselves.

    This political move could backfire on the Democrats. Companies with 50 or more employees would bare their plans a year from now just when the election campaign is heating up. These companies will be reducing the number of employees to under 50 and some, such as fast food outlets, will be reducing the hours their employees work to under 30.

    Both the immigration bill passed in the Senate and this delay with Obamacare are aimed at the elections next year as they are focused on taking back the House of Representatives so that Nancy Pelosi can get her plane back. They know that immigration can be used as a political football, one of the few they can use to their advantage, in the elections next year and why Harry Reid pushed it up to the top of the list in the Senate his year. By getting bi-partisan support in the Senate, it puts tremendous pressure on Republicans in the House relative to re-election next year.

    Their holy grail is to hold on to the Senate while taking back the House giving them, like they had in the first two years, complete control of the government to complete their socialist take over of our country.

    Like everything else the Democrats do, this delay is calculated to benefit them politically. Unless you are a complete drooling idiot, you know that Obamacare is a total mess. When this dog of a plan comes to complete fruition in 2014 the screaming will be heard nation-wide, but by then it will be too late. Those of us who buy our own insurance, without benefit of government hand outs or a company plan, have already been warned by our insurance companies about what is to come for us. Our rates, which have already gone up by over 20% in anticipation of the implementation of Obamacare, are slated to double, which makes health insurance, as we know it, an impossibility for us. Obamacare benefits free-loaders, who never bought insurance in the first place and just sucked off the welfare teat, and the wealthy, including Obama and everyone on the government payroll down the line, unions, and the businesses which were given the wavers for services rendered in loyalty to the regime. The losers are the hard-working middle class and small businesses (what else is new), the entire medical community, insurance companies and all of their employees, who will be fired when the companies who don’t play ball go under, and medical research and innovation, because, really, what’s the point? The good doctors will retire early or ride out their time as “boutique” physicians serving a small group of wealthy patients who can afford to pay out of pocket. The rest of us will be seen by nurse practitioners and will be treated by formula not as individuals, with unique problems. We will wait forever for surgeries and some smart-butt little bureaucrat, who doesn’t know the difference between a scrotum and a sternum, will be decreeing what treatments, surgeries and medications we can have. Welcome to the world of government run healthcare under a regime that doesn’t have a clue and, what’s more, doesn’t give a pooh.

    34 States have decided not to establish exchanges.

    I hope the courts will strike down the IRS regulation. The IRS, EPA and other so called “independent government agencies” aren’t independent. They are subject to the oversight of Congress; otherwise bureaucratic regulations (laws) constitute taxation without representation.

    Congress needs to exercise authority over the IRS and deny the use of a regulation to prop up a poorly conceived, unpopular, unaffordable law and save the careers of politicians that forced it on the American people.

    By his action in delaying implementation in a timely manner of a law that was passed by both Democrat controlled houses of Congress and signed by Mr. Obama, he has in my opinion, violated his oath of office ( among others) and never in a more blatant and forceful way. If the Republican leadership in Washington is incapable of calling for his resignation or impeachment, then it’s time to dissolve this party and find leaders who will act within the Constitution and for the best interests of the American people by forming a new party. When a political party fails to recognize that close to 70% of the American people reject the concept and implementation of Obamacare and close to 60% recognize that allowing illegal invaders of American soil and sovereignty have no right to obtain citizenship by fiat instead of the legal process established, then it is time to rid ourselves of the shackles of the GOP. We the people, not the elitists in DC are the owners, the protectors and legal heirs to the U.S.A. The Democratic Party has raped the American people of it’s pride, it’s treasure and it’s hope for a better life. And anyone who supports the destruction of the orderly and just process established by the Founding Fathers of this nation, are and shall be known as traitors to the Constitution and the Bill of Rights. We need to begin the process of re-establishing the rule of law and reason again in our country. God Bless America, forever!

    Obama has asked members of the NFL, the NBA, and members of the entertainment industry to help him sell Obamacare. He is also sending money down to the local level to pay teachers, librarians, and other public service workers to help sell the legislation. He is expecting our teachers to brainwash our children and hope that they can sell their parents on the “value” of the program.

    So, part of the delay may fit into giving this “grassroots” strategy time to work before the 2014 election. Obama knows that the majority of Americans do not want this government takeover of our healthcare industry.

    He knows that our younger Americans who are healthy only spend an average of $600 a year on medical care and do not see the need for an expensive healthcare insurance policy. They are going to be shocked to find they will be fined (through their tax returns) if they do not buy a $5500 per year healthcare insurance policy.
