Homeowner uses firearm to defend dog and self

Miami Herald - Don't mess with man's best friend -- especially if you don't want to end up shot and in jail.

That's exactly what happened to a Miami man after he jumped the fence -- naked, no less -- of a Little Haiti home and began choking a Rottweiler. The dog's yelps awakened the homeowner who came outside -- armed, no less -- and confronted the attacker.

The intruder, who was later identified as 20-year-old Jeffery Delice, turned his attention from the dog to the homeowner. Delice jumped on the homeowner and began choking and biting him, Miami Police said.

Fearing for his life, the homeowner fired his gun twice, hitting Delice once.

"The person was naked, on the front porch choking his dog," said police spokeswoman Napier Velazquez. "That's when the resident shot him in the foot."

Despite being wounded, Delice did not give up the fight. The homeowner, who police did not identify, fired his weapon a third time, but this time it jammed.

Finally, the homeowner was able to pin Delice down while family members called police.

When officers arrived, Delice tried to bite them, too, police said.

Delice was taken to Jackson Memorial Hospital where he was treated.

Expected to make a full recovery, Delice now faces several charges, ranging from assault, resisting arrest with violence, to lewd and lascivious behavior and animal cruelty.

He's no stranger to the Miami-Dade court system.

In November 2011, he was charged with marijuana possession, and in April 2012, he was charged with armed robbery and assault. He's never been convicted of any crime.

Although no one answered the door at the pink home on Northwest 56th Street Wednesday afternoon, a large black-and-brown dog in the backyard did come out of his dog house Wednesday and made himself comfortable in the sun.

      We also have a right to the quiet enjoyment of our property. I’d say it’s a good bet that nature boy just snapped after listening to his neighbor’s dog barking day and night for months if not years.
      Dogs that bark incessantly need to be choked, as do the owners of said dogs who allow them to do so.
      Don’t think “well, just call the dog warden or the police”. Not. For whatever reason, these people always seem to sympathize with the dog and I’ve never seen them take any effective action against either the offending dog or its owner.
      FYI, I’m not a dog hater. I own an Irish Setter, who I occasionally tie up outside. He’s trained not to bark, but even if he wasn’t I’d never, ever let him sit outside and bark at nothing, hour after hour.
      I once read of a scientific study conducted as to why dogs bark. After a year of study and who knows how much money, their final analysis was “Because they want to”.

    okk point taken but naked? That all by itself in the middle of the night on my porch would not be healthy for you.

    Throw in biting and choking and that guy is really lucky he made it to jail because one of those bullets could have solved all his mental problems permanently. And I still say well done Miami homeowner. Your rights STOP where mine begin and my right is to protect myself.

    Neighbors can be scary. I had a neighbor once threaten to kill my dog simply because she is a pit bull. She’s never once been out of my yard or shown any signs of hostility to anyone whatsoever. She’s been chased by a deer and beaten up once by other dogs and she has never bit or showed signs of aggression. Still my neighbor is bitter because I have a pit bull.

    Some people are weirdly afraid of EVERYTHING but that doesn’t give them the right to threaten us or our property when we haven’t broken a single law.

    As far as a barking annoying dog. It’s true it’s maddening but there are two kinds of mad. One kind of mad will lead you to personally speak to the dog owner and ask them to take the dog inside or you will call the police and animal control.
    The other kind of mad is called stark raving and leads to stripping naked through the bushes and choking and biting a sleeping dog (for all we know) on somebody else’s privately protected property.

      no where does in the article does it say anything about this guy being a nieghbor. This guy jumped the fense of this man’s house and attacked his dog too bad he didn’t hit his target like i was taught center mass. safe the taxpayers a small fortune and end this guy’s life of crime.

    ‎9-1-1 Doesn’t stop an armed intruder in your home. Guns do!

    9-1-1 just gets the cops there to take the report and pictures of your bodies after the damage has been done.

    Most departments also have a policy that if you report an armed intruder, they will not enter your home to save your life, until THEY have backup!
