Disgruntled worker kills 1, wounds 9, at Empire State Building

NEW YORK (AP) - A laid-off women's accessories designer shot a former coworker to death near the Empire State Building, causing a chaotic showdown with police Friday in front of one of the world's best-known landmarks. Police killed the suspect and at least nine others were wounded, some by stray police gunfire, city officials said.

The gunshots rang out on the Fifth Avenue side of the building at around 9 a.m., when pedestrians packed sidewalks and merchants were opening their shops.

"People were yelling `Get down! Get down!", said Marc Engel, an accountant who was on a bus in the area when he heard the shots. "It took about 15 seconds, a lot of `pop, pop, pop, pop, one shot after the other."

Afterward, he saw the sidewalks littered with the wounded, including one person "dripping enough blood to leave a stream."

Some of the wounded were just grazed by bullets, and all were expected to survive.

Wearing a business suit and carrying a briefcase, gunman Jeffrey Johnson fired three times at his 41-year-old coworker outside Hazan Imports, shooting him in the head, Police Commissioner Raymond Kelly said.

Johnson, 58, and the victim, identified by city officials as company vice president of sales Steven Ercolino, had traded accusations of harassment when Johnson worked there, he said.

Johnson walked away, and a construction worker who saw the shooting followed Johnson and alerted two police officers, a detail regularly assigned to patrol the 1,454-foot skyscraper since the 9/11 terror attacks, officials said.

Surveillance video footage shows Johnson reaching into a bag, pulling out a .45-caliber pistol and pointing it at officers, Kelly said. The officers drew their weapons and started firing, killing Johnson, Kelly said.

Kelly initially said that Johnson fired on officers, but police said later they were trying to determine whether Johnson actually fired shots.

"These officers ... had absolutely no choice," Kelly said. "This individual took a gun out very close to them and perhaps fired at them."

Kelly said authorities believe police may be responsible for some of the injuries because of the limited capacity of the gunman's weapon.

Erica Solar doesn't know who shot her in the back of the knee while she walked to get coffee on her way to work, said her brother, Louis Lleras.

"She just heard shots and she fell to the ground a couple of steps forward and noticed that she was shot," Lleras said.

Ercolino's profile on the business networking site Linkedin identified him as a vice president of sales at Hazan Import Corp. It said he was a graduate of the State University of New York at Oneonta

A man who answered the phone at Ercolino's home in Warwick, northwest of Manhattan, said he was too distraught to talk.

"He was a good son, that's all I can say, said the man, who didn't give his name

The two officers fired a total of 14 rounds at Johnson, Kelly said. Mayor Michael Bloomberg said some of the nine wounded may have been shot by police in the mayhem. Johnson's semi-automatic weapon was equipped to fire at least eight rounds; at least one round was left in the clip, police said. Another loaded magazine was in his briefcase.

Johnson worked at the company near the building for about six years and was laid off because of downsizing, Kelly said.

"We were just working here and we just heard bang, bang, bang!" said Mohammed Bachchu, 22, of Queens, a worker at a nearby souvenir shop. He said he rushed from the building and saw seven people lying on the ground, covered in blood.

Queens resident Rebecca Fox, 27, said she saw people running down the street and initially thought it was a celebrity sighting, but then saw a woman shot in the foot and a man dead on the ground.

"I was scared and shocked and literally shaking," she said. She said police seemed to appear in seconds. "It was like CSI, but it was real."

Hassam Cissa, 22, of the Bronx, said he saw two bodies on the ground and police applying a white cloth to a man's stomach wound.

Gunshots so close to one of the city's leading tourist attractions immediately prompted fears of terrorism, but federal officials said that wasn't the case, and a guard at skyscraper said it didn't involve the parts of the building where tourists gather to visit the skyscraper.

The gunfire came less than two weeks after a knife-wielding man was shot dead by police near Times Square, another tourist-saturated part of the city. Authorities say police shot 51-year-old Darrius Kennedy after he lunged at officers with a kitchen knife Aug. 12. Kennedy was smoking marijuana in Times Square on a Saturday afternoon when officers first approached, police said. It was the beginning of an encounter that would stretch for seven crowded blocks.

In 1997, a gunman opened fire on the 86th floor observation deck of the Empire State Building, killing one tourist and wounding six others before fatally shooting himself.

Metal detectors and bag searchers have been standard at the 102-story skyscraper since the 1997 shooting.

Millions of tourists visiting New York ascend its heights to gape over the city from its observation deck, made famous in films such as "Sleepless in Seattle." It was 1933's "King Kong" that showed a giant ape clutching Fay Wray and fending off airplanes atop the tower.

    Police stray bullets…it is said, that if the California sheriffs & police are shooting at you , keep running, cause they are such terrible shootists…I feel that same thing can apply to NYC police…meanwhile a concealed carry permit holder, is obviously an enthusiast who most likely has mastered his firearm would more certainly hit his target , before being hauled off to the hoosegow to get in touch with his lawyer & his $35,000 defense for saving the lives of others. Having a Monday night pistol league gunny in the vicinity would certainly have had a better outcome for you and everyone else…Self Defense is your only defense…look at Bloomberg…guarded by firearms wherever he goes…expecting others to jump into the fray for him in the event of chaos…what a hypocrite.

      Bloomberg has the strictest gun control laws of nearly any city so this story is hard to believe. People that obey laws do not have guns so h0w can this freak get a gun? Do you mean gun control only keeps the average citizens from defending their lives by obeying the law?

      cynicalpete, why the cynicism? NYC has one of the highest gun homicide rates in the US. Chicago may bypass it this year though. LA is pretty bad also.

      Usually NYC has over 1000 shooting HOMICIDES per year. That doesn’t include woundings and misses.

      It’s not that difficult for NYC residents to get guns. People can legally get guns in other states and sell them to New Yorkers. Also, there’re plenty of illegally acquired guns in NYC for sale if you have the money.

      Your last sentence, however, is quite true.

    Well using the same thinking as Romney being responsible for that guy’s wife who died and accusing him of murder this case would be much more obviously a case of Obama being guilty of murder since the Obama economy is still shrinking and the guy lost his job because of it. So same theory should apply. Obama and his minions made this happen!

    The thing I find interesting about this event is the fact that within 1-2 hours of the shooting, all the details about the shooter were posted online. His name, age, his motive, who he shot, etc. were all publicized.

    Normally it takes several days to get any details out of the tight-lipped authorities, so this incident doesn’t seem to fall under the same guidelines. How was all this information gathered and released so quickly? If the man was laid off “last year” due to downsizing, did he wait until his unemployment benefits expired before he sought revenge?

    I can’t wait to see how the anti- Second Amendment crowd spins this. A shooting in the city with the strictest anti- gun ownership laws in the country, and the police return fire wounded several bystanders. I remember in the Aurora shooting all the talk about how trained legally armed citizens would have wound up hitting people. I guess they’ll just have to bury this story next to all the ones where a legally armed person prevented a crime and saved lives.

      Speaking of second amendment rights. The civilian anti-gunner’s have been pressed into thinking it’s about public safety and this is a total lie! Sarah Brady, bless her soul, is only responding to her and her husband’s hurt from a deranged MIND. The gun was not deranged at all, it worked perfectly! A deranged mind will always find a method of showing it’s hurt or greed by finding a weapon it can manage. It’s moral levels have dropped to only ‘self gratification’ level when it decides to hurt someone in revenge for real or imagined ridicule of them. Gun prohibition is only used to garner favor with weak minded voters and to allow a government to completely take control over peoples lives without fear of a deadly uprising against them!
      If we keep on topic with truth, we can overcome this tyrannical attempt, by them, to take over America and the world.
      The USA is the last bastion of freedom for a hurting world, no matter what the MSM tries to convey to the public!

      The first article I read early this morning printed witnesses saying the man used “a shotgun or a rifle”, but now it is said that he had a 45 handgun in a briefcase. His name, Jeffrey Johnson, leads me to believe the shooter was a Caucasian, so before the evening news I expect to hear all about this being labeled a “hate crime by a domestic terrorist”.

      Bloomberg commended some witness, for contacting the authorities and leaving it up to “The Professionals”… to, ah, spray bullets everywhere! I am impressed by Professionals that hose lead like they are in a Sam Peckinpah movie…or Scarface. Another NYPD triumph! Do they even get to practice anymore?

      Now there are a bunch of actors wigging out, go figure, and calling for a modification of the 2nd Amendment. They need to modify their meds.

      And, the main cast of this tragedy, there was something about women’s apparel–designer accessories? Really? That is special. If that is so, perhaps this was some kind of, well, Glee Boy, anger session gone bad. Down into the Memory Hole, asap.

    Well, although the shooter here is likely white and therefore subject to being classed as a domestic terrorist by our overly-PC DHS, this appears to be truly “workplace violence,” UNLIKE what the Muslim Fort Hood shooter did, which was classed as mere “workplace violence.”

      I can’t speak for lwesson, but I can speak for myself.

      Yes, I would have done better. If it helps, I have had years of combat training (US Army) and have actual combat experience.

      There are many armed citizens who are far cooler under pressure and better shots than the NYPD. Many of whom have served or are still serving. I count two Marine roommates (one Afghan, one Vietnam) who are both armed and excellent shots.

      My main focus is the Nanny State Cheerleader, Bloomberg and his commending a lowly citizen for calling on “The Professionals” to do their job. Fine. Do your job and do it well. The police had this guy close to them, and unleashed a fusillade of bullets wounding 9 civilians and EVENTUALLY killing the suspect. 14 rounds hurled out by Bloomberg’s Professionals. Something is wrong in Gotham, Police Commissioner Trinket.

      In Bloomberg’s Police State World, only the police, security guards and military would have guns, oh, and criminals. We lowly Subjects would have to submit to being body chalk outlines, or begging for police to come deal with the bad boys hoping that they do not kill or wound too many of us, IF they get there in time.

      Those injured in NYC, well, can they sue? The domain of Government gets pretty prissy here and protects itself from being sued, usually. Here, in Government World, there is a great deal of flexibility for incompetence.

      During this month, the media generally ignored the blood soaked mayhem in lovely self righteous compassionate Gay Chicago. Wrong kind of people to put a spotlight on. In Richmond, a Wilding event goes on, but again, the wrong kind of people to notice.

      I will ask my brother in law who is a cop, and an expert shot, for his opinion. The Red Phone is ringing and lighting up now, have to go…and do a good job with Captain America.

      It is my understanding, referring to a firearms training instruction website called frontsite, that the 9 injured pedestrians were injured by friendly fire, i,e, police bullets!

      The owner of frontsite has stated if Bloomberg would simply acknowledge that armed and trained citizens (with permits)would reduce crime in the big apple, He would train all of the NYPD force for FREE! He contends the firearms training at most academies is woefully inadequate, and he may be right. Bloomberg sure hemmed and hawwed a lot during the video (which is featured on the Frontsite.com website. As a CCW holder of 19 years, I tend to agree with hm!

    The liberal media is already touting gun control but doesn’t New York City have gun control already! If gun control doesn’t work there then it will not work. If the control of illegal narcotics cannot prevent drug addition and not be controlled how do the liberals think they can control gun crimes? A responsible citizen with a gun creates a crime free zone and statistics prove it. Bloomberg is on a tour in the U.S. pushing his gun control. His big soda drink ban exposed his liberal intelligence by not having the common sense that people will just have to buy two soda drinks instead of a supersize.

    Disgruntled, my AZS! He was Pizzed off and after so long not being able to make headway, he did what he had to, to get the “devil” that turned his life, upside down. However, instead of just laying down his weapon and surrendering, he decided to run and in the ensuing gun battle, he dies, and 9 innocent people pay for his anger. I’m sure, it wasn’t just his weapon that brought all 9, down. Knowing what I do about how badly, cops shoot, it’s a wonder they got him. There are going to be a lot of lawsuits.

    Instead of gun control, the country needs more insane asylums. Before the ACLU had them closed, many shootouts were probably prevented. I am sure the theater murders could have been prevented by institutionalizing this crazy insane nut job who did the shooting.

      Sadly, mental institutions are abused by those in power, by institutionalizing those who disagree with them.

      See the case of Brandon Raub, USMC. Imprisoned in a psychiatric facility without charge after making anti-government posts on Facebook.

      Just as sad is that many of these institutions are shutting down. The State Hospital in Oregon’s capitol, Salem; was shut down about a decade ago. All but the wing with the criminally insane were emptied, most of the residents ending up on the streets. Many of whom are still homeless. In a part of the country where it rains more than it doesn’t.

      So asylums are a mixed bag, depending on those in power.

    Maybe the cops should hit the firing range instead of the doughnut shop.

    The government feels we would all be safe if we couldn’t own guns. I have a concealed carry permit and believe I have the right to defend myself. But, I’ll give up my gun if the cops give up theirs’. I apparently won’t need one if guns are illegal. Therefore the cops don’t need a gun either. Sounds really stupid doesn’t it? How come the government and liberals don’t see the stupidity of their “logic”.

    Did you know 13 people were shot in Chicago the day 0 was in Chicago? Guess the media wasn’t able to find a “hate crime” or domestic terrorism angle so nothing was reported. People are killed daily by drunk drivers, so should we ban cars are alcohol? If someone WANTS to hurt you they can find a weapon, remember Cain and Abel? It was a rock, which thankfully have all been collected and destroyed so we are now safe.

      They are the only state in the Union that outright bans all citizens from carrying handguns.

    There isn’t a “C” card carrying USPSA, IPSC, IDPA, or ICORE shooter that couldn’t have done a better job than NYPD. Is say put the rank and file back on duty with 38 Special revolvers with 5 rounds in the cylinder and let them have a high cap semi auto when they get their C cards.

    NY City gun owners aren’t allowed to carry even to the range, so criminals with a gun can rob a gun owner of his guns b/c he can’t protect them before/after going in to shoot.

    Bloomberg is an Anti-Rights person that doesn’t understand that ‘ Where law-abiding people carry, the crime rate goes down to LOW ‘, as he now has crime rates going back up in NYC, you have to rely on the NYPD which has shown time after time that they CAN’T shoot good, even though they have to qualify 1 to 4 times a year.
    As long as crime is allowed to rise in NY City, they will keep coming up with more anti-gun laws that do NOTHING to STOP Gun-Crime.
    USE the Laws already on the books? They can’t do that – they only want to put more stupid laws in that is needed to cover the PD’s ***!

    The best thing that NY and the Country can do is ALLOW law-abiding citizens that carry guns that they be ALLOWED to carry them everywhere that a Criminal, Terrorist or Loony will carry them.

    NY City is one BIG ‘ Gun-Free Zone ‘ whose gun-crimes are on the way back up. This is what happens when the Cops and Robbers are the only ones to have guns – ‘ Free Killing Zones ‘.

    I stay out of the 5 Boro’s as much as possible, I also don’t leave NYS anymore unless I can take my gun with me!

      When I used to drive to NY from here in the midwest I carried. Of course I was born in Brooklyn and much of my family lives in NY so I’m well informed of the war zone. But at least it’s not as bad as parts of Chicago.

      I assume your comment that “Bloomberg is an Anti-Rights person,” goes far beyond the issue of guns. It seems he wants to control most aspects of individuals lives.

      Next time I visit NYC I’ll be sure to order a large soda and popcorn and also a large milkshake.
