Va. veteran detained after strident Facebook posts

RICHMOND, Va. (AP) - A former Marine involuntarily detained for psychiatric evaluation for posting strident anti-government messages on Facebook has received an outpouring of support from people who say authorities are trampling on his First Amendment rights.

Brandon J. Raub, 26, has been in custody since FBI, Secret Service agents and police in Virginia's Chesterfield County questioned him Thursday evening about what they said were ominous posts talking about a coming revolution. In one message earlier this month according to authorities, Raub wrote: "Sharpen my axe; I'm here to sever heads."

Police — acting under a state law that allows emergency, temporary psychiatric commitments upon the recommendation of a mental health professional — took Raub to the John Randolph Medical Center in Hopewell. He was not charged with any crime.

A Virginia-based civil liberties group, The Rutherford Institute, dispatched one of its attorneys to the hospital to represent Raub at a hearing Monday. A judge ordered Raub detained for another month, Rutherford executive director John Whitehead said.

"For government officials to not only arrest Brandon Raub for doing nothing more than exercising his First Amendment rights but to actually force him to undergo psychological evaluations and detain him against his will goes against every constitutional principle this country was founded upon," Whitehead said.

Raub's mother, Cathleen Thomas, said by telephone that the government had overstepped its bounds.

"The bottom line is his freedom of speech has been violated," she said.

Thomas said her son, who served tours as a combat engineer in Iraq and Afghanistan, is "concerned about all the wars we've experienced" and believes the U.S. government was complicit in the Sept. 11 terrorist attacks. One of his Facebook posts, she said, pictured the gaping hole in the Pentagon and asked "where's the plane?"

Whitehead said he found nothing alarming in Raub's social media commentaries. "The posts I read that supposedly were of concern were libertarian-type posts I see all the time," he said.

The big concern, Whitehead said, is whether government officials are monitoring citizens' private Facebook pages and detaining people with whom they disagree.

Dee Rybiski, an FBI spokeswoman in Richmond, said there was no Facebook snooping by her agency.

"We received quite a few complaints about what were perceived as threatening posts," she said. "Given the circumstances with the things that have gone on in the country with some of these mass shootings, it would be horrible for law enforcement not to pay attention to complaints."

Whitehead said some of the posts in question were made on a closed Facebook page that Raub had recently created so he questioned whether anyone from the public would have complained about them.

"Support Brandon Raub" Facebook pages have drawn significant interest, and other Internet sites had numerous comments from people outraged by the veteran's detention.

Raub's supporters characterized the detention as an arrest, complaining he was handcuffed and whisked away in a police cruiser without being served a warrant or read his rights. But authorities say it wasn't an arrest because Raub doesn't face criminal charges.

Col. Thierry Dupuis, the county police chief, said Raub was taken into custody upon the recommendation of mental health crisis intervention workers. He said the action was taken under the state's emergency custody statute, which allows a magistrate to order the civil detention and psychiatric evaluation of a person who is considered potentially dangerous.

He said Raub was handcuffed because he resisted officers' attempts to take him into custody.

    this is very scary. the ussr used phychatric hospitals as a way to jail anyone the govt thought MIGHT be subversive. the persons would be held there indefinitly, with their mental health as the reason. this story sounds like a trial baloon by our current administration. the mental health reason was used, so whatever un or other human rights investigators could not site human rights abuse by the ussr.

      So very well used in the Soviet Union, with snitches such as your own children, co-workers, always watching and waiting for Badthought, Hatethought, behavior. In the later, less ugly days, there usually was one or two warnings. Here, Das Stat, just swooped in applying the Virginia code…

      When will complaints come from readers here? Will cameras view us, and take biometric measures if we are being unhappy with the State? Facecrime in Orwell’s 1984 novel. It happened in what was once England during this year’s Olympics! Throwing the man off a wall, detained and questioned for 5 hours because he was not smiling at the Olympic bike event! But, Mark Worsfold, Facecriminal, said he understood!

      I wonder if Raub was commenting per axes, channeling the recent idiotic, Lincoln Vampire Killer movie? If his over the top quote of about severing heads is in this movie… . Lincoln used an ax. “Mister Lincoln, come with us. No, we are not arresting you, JUST taking you away.”

      Yes this is scary. But wait a minute! This young man believes that 9-11 didn’t happen! That 9-11 if it did happen was Americas government doing this all by themselves??? Perhaps this young man does need a little help. 9-11 did happen and the facts are the fact, viewed by millions of Americans. Osama BenLaden ADMITTED to his complicity in the horror exercised against America.
      This is a direct result of governments dumbing down of our youth in keeping history out of our schools.

      If they were acting under a state law, why was the FBI and Secret Service involved? I didn’t see anywhere that he threatened any specific person. Actually I didn’t see any direct threat at all.

      Raub posted Facebook messages that suggested that the US government was behind the 9/11 attacks, and signed a petition to re-open the investigation into the terrorist act.

      Genesal, since none of the people who are commenting on this thread know the true extent of his comments other than those that have been posted and, the fact that the FBI and Secret Service are involved, he may have crossed the line and threatened federal property and or federal personnel in some other context.

      Just looked at his Facebook site, Blu Owen. No threats to any particular person, period. I am not sure, but even Canadians might not be too offended, eh.

      He does seem to not have a very favorable take on the Federalales that run the shop. Very naughty. Lumps of coal for him this Christmas!

      Raub posted some Rap that is amazingly gross, but that is NOW, sanctioned, inspirational music. I think that The Commander of Chief even has some favorites. Don’t think that Raub actually likes Rap… .

      I was curious, maybe a bit suspicious, when I peeked in, but this is lame and says much as per how thin skinned the Power Elite are. Who knows, even guilty? Naw. Never. I embrace the Power Elite. They inspire me towards greatness, purity of essence… .

      Youtube, the arrest of Raub, bna42 and all. What a chilling, disturbing video of this man’s “ah, not arrest, handcuffing and being hauled away” to someplace.

      The agents with sunglasses, I guess they were so cool that they had to wear shades, were not amused to be photographed. They did a fine job trying to look like Rapster guards, intimidating, but came across as lowly common poorly dressed thugs. (I was thinking Matrix Agent threads, when I should have been imaging, Goodwill clothing.) The regular Police looked, well, not happy. Things yet to come?

      Catch this before it is taken down. So very ugly.

      To all, one of the features of Facebook is the ability to filter who can see what you post. There is public which is probably what you looked at. The others are the people that you have accepted as friends, friends except acquaintances, close friends, family, and custom which allows you to specify which people you wish to see your post. You can also put up a Facebook page and be less or more restrictive depending on who you allow to see the page.
      This is why I stated that just by looking at his public comments does not necessarily tell the whole story and also he may have made comments on other sites that we the public may not be aware of. That being said I stand by my position.

      Blu, do you really think the federal government can be affected by whether you “specify” who can see your posts on a social networking site?

      There is no privacy on a public networking site and there certainly isn’t any privacy when dealing with a government that will do anything to spy on its own citizens.

    Hold on a second! Raub wrote: “Sharpen my axe; I’m here to sever heads.” What would have happened if he HAD taken an axe out and severed heads and the authorities did nothing to stop it? There would have been a public outrage!

    People are responsible for their comments. Freedom of Speech does not mean you can say whatever you want without consequence, including written comments on Facebook, which is not private. You can speak of a coming revolution without making ominous threats. His threat to sever heads with an axe is what landed him in a padded room, not his declaration of a coming revolution.

      We know what happens when the progressives refuse to use mental hospitals to secure really ill people. Look to AZ, and the recent shooting in CO, and DC to see how well they protect us. This man may need to be evaluated, but I see worse every day in comments all over the web. When will they arrest the leader of the New Black Panthers that publicly stated they need to set nurseries on fire to burn up cracker babies, and they should pull whites from their house , hang them up, and skin them alive. OH, I forgot that is protected speech.

      Doesn’t that sound like a threat? Obama has over the course of his first term made many threatening statements that were used to intimidate and even divide the people, but he is not challenged because he is a product of the Chicago-style political machine.

      Very quickly we are seeing a National, wrong kind of person vs a right kind of person per actions, per rights and “rights” like voter intimidation, that are patently illegal. Eric Holder, holds a special kind of key here.

      Someone that I know that is a police officer, has chilling stories aplenty at how the Dept. sanctions the “correct” attention to crimes, sanctions approval of claims of discrimination, and the resulting punishments. One way to make the crime rate go down, is to ignore the criminals… and if you do not, you are punished.

      Ah, the ’70′s I kind of dimly recall them. I think, A Bicycle Built For Two, was a hit? No, that was the early crazy ’90′s.

    “We The People” need to see how Congress has enabled these pre WWII gestapo tactics .

    Congress nullified the First amendment last December. Obama signed said Unconstitutional law New Years eve 2011.
    The law enacted is a Blatant act of Treason against American Citizens. This law coincides with another Previous act of Treason by Congress and Bush .
    Both these acts of Constitutional Treason have brought the New World Order down on all Peasants of the U.S..

    I can only Hope & Pray that the Illegal ,Unconstitutional incarceration of Brandon Raub will be the First & Last Challenge to , & the Judicial’s Nullification of the illegal “ACTS” signed by Bush and Obama.

    Brandon’s Rights of Free Speech has Branded him a potential Threat under NDAA without Due Process. Period..

    And nothing is being done about the treason Obama has perpetrated? More corrosion of our rights under the Constitution Obama ignores the Constitution at ever turn. He used American troops to advance the “Arab Spring” agenda of the Muslim Brotherhood he places them inside of our Homeland Security, the Secretary of State and the White House, and shortly after their inclusion all of the CIA’s agents in the Middle East were named, hunted down and killed.
    instead of the obvious violations of the law and the Constitution they go after a veteran expressing his God given right to free speech.       A few (or more) questions come to mind. Hopefully I can remember what they are.
      1. Just what are the guidelines for becoming a “mental health crisis intervention worker”?
      2. Where and to whom do I apply?
      3. Who’ll oversee my actions? (the doj, dhs, nbp, or all of the aforementioned??)
      4. How much power will I have?
      5. Do I get to wear an armband & what will it “say”?
      6. Will I get to carry a gun, taser, pepper spray, & tear gas?
      7. Will I be issued a gold badge?
      So many questions! Although, I believe there were more.

    There is a legal restriction on First Amendment rights that concerns so-called “fighting words”: http://en.wikipedia.org/wiki/Fighting_words Like it or not, you are not allowed to incite violence or hatred. “Sharpen my axe; I’m here to sever heads” is the kind of expression that reasonably fits the definition of “fighting words”. That does not mean that you cannot express outrage or opposition to government policies, political parties or personalities, etc.; you just cannot promote violence. The problem is that the Obama administration has labeled various conservative and libertarian groups (e.g., survivalists) as potentially violent. That is a very troubling development, although it might have played no role in this particular case. I hope people who thought the Patriot Act was a wonderful law targeting Islamist extremists will now have second thoughts. This is not a Democrat or Republican problem. It is an American big authoritarian government problem. Just keep track of what goes on in places like Russia and Ukraine with regard to anti-government groups that do not advocate violence. That is our future if we either remain complacent or bark up the wrong tree.

      I read the Wikipedia article. I am not sure that Wikipedia is the end all source for all information. First off, they talk about HATE speech. They quickly quote Canadian law. Canadian law is so akin to Soviet State law that Canada is null and void on Free Speech, as compared to that within the US Constitution. Including HATE SPEECH slides you quickly into a Gulag. If this is hateful, Gulag here I comesky.

      Further, reading on down the Wikipedia article you see that someone in a personal way, must be the recipient of having said head, severed in the US of A. From what I have read about Brandon Raub, it was a general statement, sharp and over the top yes, actually axing someone, no. Movie, “Wyatt Earp”, “Tell them Hell is coming…” might seem angry. The Michigan Militia group, had the Feds all over them and in an instance of amazing clarity, the Courts did not back the Feds.

      What is really creepy, is to think that our Founders were way way over the top. Of course, King George had a rope like solution for that silliness. Advocating separation, independence? Heresy! Much blood was spilled, and later still, much much more.

      And who knows, maybe this guy is actually crazy? The problem is that if we are to have Liberty, Freedom, there is a price to be paid. It is constantly paid. What Das Stat is trying to do, is a strong armed counter to the right of free speech, making preemptive, very selective busts, in who is free to speak, and who is not. Raub is obviously not.       Of course, Das Stat also wants to disarm, We the People. All for our own good you know. How thoughtful. All Totalitarian States, do not want an armed populace.       Lastly, we do not have to look at Russia, (never a very free place to speak) we can look at our Mother Country of England and see the jack boots of 1984 stomping away.

    I find it odd that they say he was not arrested. In Santa Maria Calif, one of the most frequent charges stated in the local paper is “he was arrested for resisting arrest, with no other charges”. Let that sink in. Many are arrested and only charged with resisting arrest, which make me wonder, why did they attempt to arrest the person in the first place, if the only arrestable offense came after an illegal attempt at arrest for no reason, and that sparked their resistance. Which of course makes the resistance itself legal.

    If an officer attempts to cuff you without a legal reason to do so (you have not yet committed an arrestable offense) then resitance is not an offense since it is he that is acting illegally. If he says you resisted arrest, he needs some legal reason for that attempted arrest, and the legal reason for the attempted arrest cannot be what happens after that attempt, it needs to be the initial reason itself. Thus when a person is only arrested for resisting arrest, something definitely stinks.

    Perhaps that is why those police will not admit he was arrested, even though cuffed.

    If you watched the video one of the girls who where filming his arrest asked either two FBI agents or two Secret Service
    agents if they would please remove their sunglasses so she could get a good shot of their faces,they looked at her for a couple of seconds and then turned around ad left,as they where
    leaving you heard the girl say,OK thats alright we have your faces anyway.So,I don’t know who she was but whatever she does
    please keep your eyes open or you’ll be next

    Why aren’t they going after the Black Panthers with them making satements about KILLING ALL WHITES? Because Obama and Eric Holder support the Black Panthers and what they do and want to do.

    So during an Aug. 12 rant on Black Panther radio, she let loose not only on “crackers” but also on black conservatives. During a particularly colorful diatribe explaining why she hates whites and why all blacks should, too, she vowed that as long as whites keep characterizing blacks as “ni**ers,“ her ”feet [will be] on your motherfu**ing necks.”

    The New Black Panther Party is the Old Black Panther Party. A rant from a black woman from Tampa, Florida, blames the Republican Party, the Party that “hates black people” (her words), for the violence that’s going on in the city. She ended her rant on a “black power” radio station with this threat:

    Last Wednesday August 15th, a conference call with New Black Panther leader Michelle Williams and others in their organization was recorded. In that call she made direct threats to anyone in Florida involved with the Republican National Committee’s convention and chastised black conservatives like me. Some of the words she used in that call were “Florida should be in flames”, “Our feet will be on your mother***ing necks”, “crackers”, “honkies” and more too vile to print.     Report: FBI informant armed and trained Black Panthers

    A video published Monday by the Center for Investigative Reporting reveals that the man responsible for arming and training members of the Black Panther Party in the 1960s did so while acting as a federal informant.
    According to reporter Seth Rosenfeld, Richard Aoki was approached by FBI agent Burney Threadgill Jr. in the late 1950s, around the time he was graduating high school, and developed into a source into the activities of various political groups during the following decade.
    “I said, ‘Well, why don’t you just go to some of the meetings and tell me who’s there and what they talked about?’” Threadgill is quoted as saying. “Very pleasant little guy. He always wore dark glasses.”
    Aoki, who committed suicide in 2009 after working as an educator for 25 years following his involvement with the party, has been remembered for his activism. He was the subject of the biography Samurai Among Panthers: On Race, Resistance And A Pardoxical Life, which traced his ascent within the organization, where he became the highest-ranking non-black member of the party.
    Rosenfeld wrote that he discovered Aoki’s double-identity while researching a book of his own, scheduled for release this week. He also noted that Aoki disputed the allegation during a 2007 interview, saying he thought Rosenfeld was mistaken before adding, “People change. It is complex. Layer upon layer.” Aoki did, however, admit to “cutting a deal” with military authorities while serving in the U.S. Army, sealing the criminal record he had amassed in his youth.
    Aoki would go on to serve in the Army reserves, during which time, Rosenfeld writes, he filed reports to Threadgill detailing his involvement in groups like the Communist Party, the Socialist Party, the Young Socialist Alliance and the Vietnam Day Committee. By the time Aoki met Huey Newton and Bobby Seale in Oakland, when Newton and Seale were developing what would become the Black Panther Party’s 10-point program, Aoki had been assigned to another agent.
    In his interview with Rosenfeld, Aoki said he provided weapons and training to the Panthers.
    “I had a little collection, and Bobby and Huey knew about it, and so when the party was formed, I decided to turn it over to the group,” Aoki said. “And so when you see the guys out there marching and everything, I’m somewhat responsible for the military slant to the organization’s public image.”
