Default For Sotomayor, discrimination case likely issue

By PETE YOST

May 27, 2009

WASHINGTON (AP) -- When an important reverse discrimination case came before federal appeals court judge Sonia Sotomayor last year, she and two other judges issued an unusually brief decision that went against white firefighters.

The judges' conservative colleagues on the court strongly criticized their terse decision. Today the Supreme Court appears to have serious questions about the ruling as well.

Sotomayor, President Barack Obama's choice to replace Justice David Souter on the Supreme Court, is likely to face questions about her legal reasoning in the case at her Senate confirmation hearing, with Republicans anxious to paint a picture of a liberal judge.

The Supreme Court is expected to rule in the case by the end of June.

WASHINGTON (AP) -- As a senior at Yale Law School, Supreme Court nominee Sonia Sotomayor forced a Washington law firm to apologize for what she considered discriminatory questions that a partner asked about her Puerto Rican heritage during a recruiting dinner.

The questions included: "Do law firms do a disservice by hiring minority students who the firms know do not have the necessary credentials and will then fire in three to four years? Would I have been admitted to the law school if I were not a Puerto Rican? Was I culturally deprived?" according to a December 1978 Washington Post article about the incident.

"... rejected the firm's first letter of apology as too weak before accepting its second letter."

That case my god! That case alone should simply disqualify her, though i have no doubt this woman will be confirmed and the weak backbone of my party will do nothing because they are afraid to fight this nomination.

Would that the Congress could slow down this nomination until SCOTUS rules on the discrimination case before them. It would certainly put a spotlight on Sotomayor's record of
rejection by the high court. I fully expect the court to overturn her again.

Thumbs up Re: For Sotomayor, discrimination case likely issue

She has 60 reversals already and if this one,w hich I believe will be overturned, should tell everyone in the Senate that she has no business being even considered for the Supreme Court.
