Default History And The Judiciary

I am neither an attorney nor an expert in constitutional law. Others have been good enough to say I am a good strategist. If so, then I would like to share my perspective of the current state of the judiciary. I have listened as a debate is occurring over the proper powers of the courts and the tendency of some Americans to cede to the advocates of unrestrained judicial power victories to which they are not entitled.

I am occasionally referred to as a "founder of the modern conservative movement." Such an honor places upon me and others to whom such a description applies a special duty to warn our fellow citizens. Americans today are witnesses to the realization of the great fear of our Founding Fathers: the passing away of government "of the people, by the people, for the people," as President Abraham Lincoln stated, in the United States of America. With respect to the courts, we need a revival of the rule of law based upon the constitutional principles laid down by those who founded this nation.

This is more than twice as long as anything I've seen Weyrich write before but it's important.

It's a warning of what we are losing to the judiciary, black robed tyrants.

As long as this article is, it's well worth the read.

The judiciary began usurping powers under Chief Justice John Marshall in the early 19th century declared that the Supreme Court was the final arbiter of questions concerning the Constitution. Apparently, he'd never read Article III that clearly specified and limited the court.

In fact, under Article III, Section 2, Congress can tell the court it has no jurisdiction on any matter except treason committed by high officials and disputes between states.

Or, the Court can simply be ignored. As President Andrew Jackson said, "The Court has ruled, now let them enforce it."

The Court can only issue opinions. Enforcement of them can only occur with the consent of at least one of the other equal branches and it's about time they started to back down.

No, we are not a nation of laws. We are a nation governed by the consent of the people.

Tyrants? Yes! I would also add the word Dictators to the list. I guess they're about the same though.
