Default Analysis: Court's course in next president's hands

By DAVID ESPO
Associated Press
June 13, 2008

WASHINGTON (AP) -- In a campaign dominated by the economy and the Iraq War, the Supreme Court's 5-4 ruling Thursday on detainees at Guantanamo marks a forceful reminder that John McCain promises one course and Barack Obama pledges another in picking future justices.

In the current controversy, McCain quickly expressed his disapproval of the opinion, while Obama issued a statement of support. It fell to outsiders to point out the broader implications in the race for the White House.

''With the replacement of a single justice from the majority ... today's four dissenters could become tomorrow's majority,'' said Nan Aron of the Alliance For Justice. The group supported the court's decision, which said detainees in the war on terror held at Guantanamo have the constitutional right to challenge their incarceration in the federal courts.

If there is one over-riding reason to vote for John McCain it's the kind of Justices he would nominate for the SUPREME Court.
Nothing a president does in his term of office will have the long-range effects as the Justices he
sends there.

John McCain has promised to look for Justices in the mode of Roberts and Alito.

If Obama gets in, God help us, our laws and traditions will mean nothing.

Amen Jamble. This is the main reason I will hold my nose and vote McCain.

And you can add my Amen to Thomas's

We need McCain. I believe he will give us good justices. maybe not, but we have more of a chance with him than with the BO..

Go for it, McCain

The next POTUS, in all likelihood, will fill at least one Supreme Court vacancy, based on the ages of the current justices.

Given Obama's stance that the role of the court is to protect people who are "the outsider, the minority, those who are vulnerable, those who don't have a lot of clout,'' is there any question that Obama will nominate SC justices who are activist judges?

And it is not just SC justices -- there are federal judicial appointments all over our nation waiting to be filled (and many appointments are being stonewalled by the current Congress). Imagine if federal appeal courts throughout the United States were populated by justices along the lines of the Ninth Circuit . .

Quote:
"...determined on the basis of one's deepest values, one's core concerns, one's broader perspectives on how the world works and the depth and breadth of one's empathy."
This quotation of Hussein's mentions nothing about the Constitution. The reason we have a Constitution is so we aren't ruled by whimsy as articulated above.

To paraphrase Justice Antonin Scalia, "The constitution is not a living organism; it's a legal document." In other words, it's a contract and when a public official, such as a judge, fails to uphold his oath to protect that and cites foreign sources for decisions, that should be grounds for impeachment.

Angry Re: Analysis: Court's course in next president's hands

After this week's Supreme Court decision, we can only hope McCain will live up to his promise. He did make a derogratory remark re: Judge Alito sometime ago. I do think we stand a somewhat better chance of getting a decent judge nominated with him than we do Obama.
But McCain has to get his judges past the liberal judiciary committee. The liberals on that committe have a VERY liberal litmus test a judicial nominee has to pass and without some intervention, God help us.
We saw this week a law that has served us well for over 200yrs., just flushed down the drain by five judges who think they know better than the founding fathers. What evil arrogance they displayed. Now, terrorists have our rights too, and that ought to be grounds to get the judges who took part in this farce recalled, if that is possible. They are there to uphold the law as it reads, NOT CREATE LAW to suit themselves.

Thumbs up Re: Analysis: Court's course in next president's hands

I await with much chagrin the day that liberal, Godless judges meet the real Judge who is Just. What a day that will be when their tongues will not cleave to the roofs of their mouths and their knees will bend to to pay homage to the One and Eternal Judge, confessing His Lordship. They will finally understand what Jesus meant when He said ' suffer the little ones' not just the born but the unborn also. We can only pray that the liberal justices' demise is sooner than later. "Unto him whom much is given much is required" what a terrible day that will be.

Yes YahSinger, the justices will stand before the Lord God one day and find out that they themselves were not God. How sad and terrible that day will be.
And by the way: Welcome to the forum

And just for a piece of information: John McCain has blasted the SCOTUS decision regarding the Gitmo detainee's. And he blasted it in no uncertain terms. Good for him. Will make it easier for me to vote for him

Thank you Lorraine. I am a Proud U.S. Air Force Vietnam Era retired Vet now working for the U.S. Army side of the house.
What arrogance and defiance these SC Justices exhibit and even the lower courts judges. McCain wouldn't be my first choice for president but he is at least a better choice than Hussein.
One nagging question about Obama-If his Muslim father gave him his current name and he claims he has no Muslim ties, then why when he embraced the Christian way(if you can consider the Trinity United Church of Christ "Christian") why didn't he take his Christian name back?
