Default Judge Rules Against Hazleton's Crackdown On Illegal Immigration

Illegal immigrants and their special interest groups got a helping hand on Thursday from U.S. District Court Judge James Munley, a Clinton appointee, who ruled unconstitutional two Hazleton, Pennsylvania, laws designed to crack down on illegal immigration. The judge issued a permanent injunction preventing the City of Hazleton from enforcing the Illegal Immigration Relief Act and the Landlord Tenant Ordinance, which were intended to prevent businesses from hiring illegals and landlords from renting to them.

Judicial Watch believes Judge Munley is wrong on this issue. In March, Judicial Watch filed an amicus curiae brief on behalf of the City of Hazleton. Here, in a nutshell, was our argument:

"...The City of Hazleton has found it both reasonable and necessary for the public health and welfare to exercise its police power by enacting [these ordinances]...The subject matter regulated -- the employment and harboring of persons 'not entitled to lawful residence in the United States, let alone to work here -- is certainly within the mainstream of [the City of Hazleton's] police power...'"

Hooray for Hazleton, it's nice to see a community trying to defend it self from the illegal alien onslaught. Judge Munley, exactly what laws was Hazleton in violation of? If i were the Mayor of Hazleton, heres what i'd do until the appeal to the case is heard. Any illegal alien brought in for any crime (not murders) would be held in the local jail until such time you had enough illegal aliens to fill a bus. The illegals would then be loaded on to the bus and driven to Judge James Munley's front door and dropped off. On the bus ride to Judge Munley's home, It would be explained to the illegals that the Judge would love to hear their views on immigration, so feel free to knock on the judges door (no matter what time it is) to talk with him. It's about time Knit wit Judge's Like Munley have to live with the results of their rulings.

Why are stupid US judges giving constitutional rights to non-citizens?

Morons like this are living proof that the theory of evolution is a fallacy.

I guess I grew up watching too much TV. I always thought that judges were wiser than the average man...they have since proven me wrong.

Disillusionment is rampant among Americans because they have a governmental system that has consistently allowed radical views to trample the rights and freedoms of citizens. Being an American is being devalued by our judicial and governmental systems. We are told those who are not citizens and who are here illegally having broken our laws to get here and stay here, have as many rights as we citizens do. We are told we must overlook lawbreakers and grant them exactly the same rights we have, because the law protects them.
At this point, our own systems seem to place no value on being an American. In fact, as a citizen we must allow all others the rights we have even when they are stealing from us and breaking into our homes. Self defense has apparently become unacceptable conduct.
How can the law say we must permit those here illegally to enter into legal contracts? How can anyone enter into a legal contract if they have no legal standing to do so? A lease is a legal contract, employment is a contract, a drivers license is a contract, insurance is a contract. If one is illegal, if one has no legal right to be here, they can have no legal right to contract themselves or for others to be bound to an enforcible contract!
The people of Hazelton, should have the right to regulate if landlords can rent to illegals. The people of this community should be able to say there can only be so many occupants per household depending on square footage. If the people of Hazelton want fire regulations, and they want those regulations to protect the community by preventing over-occupancy, then they should have that right to limit occupancy so long as those limitations are not unreasonable.
This is another case of a federal government out of control and a jurist acting to impose his or her sense of what is morally right based on a social belief. The ruling does not reflect law, it reflects the judges belief illegal aliens should be permitted and there should be no restrictions or borders.
These views are all well and good so long as they realize that if we fail to secure our borders, innocent Americans may be killed by those who hate us just because we all fail to worship as the killers demand. Ironically, the terrorists using religion as their crutch really only want power and money. Their greed for wealth and power has little or nothing to do with religion. Just as a rapist wants power, these animal terrorists want power. They are as despicable as a rapist and in my opinion, moreso!
I hope a higher court overturns this and with gusto! Lets get it to the Supreme Court quickly where Americans can have their day. The court must decide. Can Americans decide their own fate or must we bow to a tyrannical form of governance that tramples the individual rights of a free people? If the government and the legal system can do this, then we have no rights and no chance to survive!

This is further reason why we so desperately need to return to the plan our founding fathers worked so hard to create for this Country and that worked tremendously well for over 150 years until the "modern" era. It has become obvious why their plans were to have a VERY weak federal government and nearly all matters to be handled on a state and local level.

The interference by federal government in local affairs such as the Kelo eminent domain catastrophy, the Hazelton immigration situation and the running of our schools, to name a very few, is 180 degrees out from the original intent of the founders of this country. And now they are trying fervently once again to take our guns away. I never thought I'd see the day that Marxism would come to the United States of America. God help us all!

All of the above postings point to one very critical aspect in this battle to protect American sovereignty:

Us individual American grass roots conservative citizen need to carry a life style of pro-active citizenship which includes voting for the best all-around conservative hirelings that we can aggregately and individually find and cultivate. No more of this suicidal vote boycott behavior like last November. No more of this "punishing" Pubs. We need to be encouraging and supporting conservative Pubs in the uplifting sense, not tearing down in the negative sense.

We need to support conservative hirelings where ever and when ever we can. This includes feedback accountability to make sure they don't stray.

Then, as we resultantly have better and better conservative hirelings, we can expect an increasing amount of Congressional and state house influence, thereby increasing our conservative opportunities to have a judiciary at all levels of our self-governance who interpret the law as given by our legislatures signed off by our top executives. This includes feedback accountability on our hireling reps to see to it that judges do just that, more and more as time goes by and we conservative citizens keep the pressure up.

This self-governance citizenship life style is a journey, not a destination. And on this journey, as we pile on incremental success on incremental success, we conservatives will gradually build a common basis around which we can all rally. We have our conservative media: Fox, WashTimes, our Forum, etc, etc, and a huge internet conservative media presence composed of an innumerable number of organizations covering every issue of conservative concern to counter that insidious blatant mind-poisoning liberal MSM. We DON'T need the MSM to get our critical news, except to monitor the level of liberal slant and selective/non reporting.

As Mr. Fitton said, about keeping that pressure of conservative feedback accountability up:
Quote:
So please let your senators know what you think of the liberal hold-up of good conservative judicial nominees. The number for the Senate switchboard is (202) 224-3121.
Our life style of citizenship at work. And we have a great GOPUSA "Online Activist" to help us accomplish it. If we conservatives can get H.R. 1640 (protecting Americans from terrorist lawsuit from reporting suspicious activity) passed by a Congress quite antagonistic to it and signed off by President Bush, we can get any and all conservative legislation and nominee confirmations accomplished in Congress and the state houses.

And it's working:
Quote:
Here's how the coalition put it in a letter, dated July 25, 2007: "That approval ratings for the 110th Congress are among the lowest in history is a testament to the American people's concern that their elected representatives are more interested in partisan politics and politically driven investigations than in making progress on the issues citizens really care about.
The liberal Democratic leadership of the 110th Congress openly promised these kinds of investigations. Our feedback accountability told them just about how little we think of their actions--as one of the worse Congresses in American history.

Let's translate this conservative momentum into conservative hireling victories in November 6, 2007, and then in November 4, 2008, so that we can begin to deal positively with this illegal infiltration, SPP sovereignty, and judiciary problems among other anti-conservative problems, that Mr. Fitton described.

We are still the government by the People, for the People, and of the People, and we conservatives are bound and determined to make it so and keep it.
