Shapiro: Obama - Constitution 'Constrains' Me

In his pursuit of overarching gun control legislation in the aftermath of the Sandy Hook massacre, President Barack Obama has been dogged. He's been relentless. He's been demagogic, too, whether flanking himself with schoolchildren (the implication being that his political opponents don't care about dead kids) or suggesting that if just one life can be saved by his legislation, we ought to buy into it wholeheartedly (a proposition that would justify almost any sort of government overreach).

But on Wednesday, President Obama took his gun control push a step further: He admitted that only the Constitution stands between him and full gun confiscation. Rejecting concerns that new background checks might be a prelude to gun seizures, Obama suggested that worries about gun seizures were empty, and were only designed to feed "into fears about government. You hear some of these folks: 'I need a gun to protect myself from the government. We can't do background checks because the government's going to come take my guns away.' The government's us. These officials are elected by you. ... I am constrained as they are constrained by the system that our founders put in place."

This is deeply frightening language. The notion that government tyranny is impossible in an elective republic is insanity of the first order. Hitler was elected chancellor. Mussolini manipulated his way into power through constitutional means. Hamas was elected in the Gaza Strip. Mohammed Morsi and his thuggish Muslim Brotherhood were elected in Egypt. If rights are dependent on votes -- if we only have a right to bear arms because a majority of the population elects politicians who say we have a right to bear arms -- then we have no rights at all.

The point of rights is to guarantee them against government. That is why the founders stated that rights descend not from government -- not from "us," as Obama would have it -- but from God or nature. And in truth, Obama feels the same way about rights he thinks are universal, including the so-called right to same-sex marriage or the right to abortion. Reverse Obama's argument by stating that radical feminists worry about a complete ban on abortion, but that feeds into fears about government, which after all, is only "us." Would Obama agree with this? Or would he say that true rights cannot be violated, even by a majority vote?

Government is not us. Government is a group of people elected by us, who then use their own judgment. If government were us, we would be a pure democracy. And even if we were a pure democracy, that would not give us the right to violate the rights of others. The logic Obama uses with regard to gun control is the root of fascism and oppression. Liberalism is reliant on the concept of rights that supersede popular whim. And the greatest right -- the right that protects all other rights, especially when popular whims turn against human liberties -- is the right to bear arms.

If Americans weren't afraid of government violation of rights before Obama spoke about guns this week, they should be now. This is a president who cannot understand or willfully ignores the notion of tyrannical government. And if he refuses to see that possibility, then American rights are very much in jeopardy.

    I think Obama ignores the fact that we KNOW he has violated “the system that our founders put in place”, the Constitution, many times and in areas where he doesn’t agree with it. Private ownership of firearms is definitely one of the areas where Obama doesn’t agree with the Constitution, so expect him to find a way to circumvent it in order to disarm law-abiding citizens and destroy the effect of the second amendment.

      I’m 61 and i hope i am dead when they start taking the constitution apart.I believe in the 2nd amendment and will not give up my guns for any law as long as the 2nd amendment still stands

    It was self appointed Political Messiahs like Obama that our founders forsaw and provided us a 2nd ammendment to protect ourselves from. Self appointed deciders of how other people should live their lives and who should spend and have access to their hard earned private property. Before they can attack your private property they must first remove that which protects it. Obama kids nobody but the blind as to what his ultimate goals are,,,,to reshape American society into a divided nation of consumers attacking the nations producers as our economy which is the very thing that funds out military protection from without and our guns which protect us from the political threats within ,become weakened to the point of extinction. When the eagles, falcons and birds of prey become extinct, the vultures and social parasite locusts can flourish.

      I AGREE, a nation divided against itself, cannot stand. His agenda from the gitgo has been quite clear to anyone who bothers to pay attention. But most have been caught up in the silly diversions, or refuse to acknowledge what is truly happening to our nation. We will, or already have, reached a point of critical mass from which there is no return. I can think of at least a dozen executive actions which should have resulted in articles of impeachment, but our elected ‘representatives’ have responded with the sound of crickets. Jesus, come soon!

      bwtanker, I have contacted members of Congress on several occasions asking about impeachment because of some of Obama’s crimes, yet they won’t even discuss it. I think there are two reasons: 1) they don’t want to have a race war in the streets, and 2) they are afraid of Obama because he is a Chicago-based thug.

      What other reasons would there possibly be for allowing a President to violate federal laws with no challenges? Even the Supreme Court has allowed Obama to bully them, and no one will even entertain the idea of investigating his eligibility to hold the office.

      Everyone seems to be so offended by standing up to the “first black president” that they allow him to do what he wants to do without regard to the law. As long as people like Harry Reid and Nancy Pelosi are in Congress, no one will chllenge Obam on anything.

    The Constitution is supposed to limit the power of the executive office. It’s supposed to be a system of checks and balances. Unfortunately, we are over-represented by homosexuals in government, both parties, who collaborate and collude to further their destructive homosexual agenda, that is in part, responsible for the downward spiral we currently face. The homosexual agenda wants to over-ride the will of the people. That’s immoral. As an example look at how the majority voted on the marriage issue in California. It was undemocratically ushered into a homosexual supporter so it could be deceitfully over-ridden. The homosexual community has no respect for Law. They feel they are above the Law. They are immoral. Their CHOSEN “alternate” lifestyle is DEFIANTLY OPPOSITIONAL to Universal and Natural Law. Male + Female, is the Natural Law and the Universal Code. Homosexuals engage in Immoral, Unnatural behavior, that is destructive to the uniform code of natural behavior. They don’t reproduce, they don’t abide the Universal Code, they are decidedly, openly, and willfully immoral. Law, Natural Law and Universal Code, have no meaning or value to them, that is partially why we are downward spiraling. They don’t adhere to constructive morality, instead, they are destructively immoral. They are destructively ANTI-Humanity; they don’t reproduce. They are destructively immoral, they OPPOSE family morality and the morality of the Natural Order and the Universal Code, male + female. We have far too many deceitful homosexuals in government, deceitfully destroying our system. They immorally use (hijack) the (born black at birth) civil rights issue to pretend they too were born (blatant lie) in an under privileged environment. In the past we were much happier and far better off without sooo many of them in office. They’ve made matters WORSE. Our answer as far as I’m concerned is to “Vote Incumbents Out!” Lets get back to our real system of family moral government with real people who do NOT have a deceitful, immoral homosexual agenda. “Vote Incumbents Out!” Thank You.

    Hussein “I am not a Dictator” Obuma has SWORN to protect, defend and uphold the Constitution of The United States of America. This would mean as it is written, as defined in the Federalist Papers, not as Hussein “I am not a Dictator” Obuma imagines it to be.
    Violation of Oath of Office should be a impeachable event.
    This will not happen so long as our spineless legislators are owned/controlled by the privately held bank/money cartel known as The Federal Reserve Bank. This Cartel also OWNS The Office of the President and controlling interest in most mainstream media outlets.

    We as the people of this country are seriously in jeopardy of being overpowered by a now a self proclaimed tyrant. Not wishing to be constrained by the constitution as the writers intended, Obama continues to peruse the position of dictator vice president. The congress must take the appropriate action to relieve him of his position before he gains the full support of the subversive socialist and anti-American elements of this country. Many of our congress have already capitulated and more are falling in. They need to read history as to what happened to the politicians that put Hitler and other dictator I power. Recent legislation is indicative of actions to come. His undaunted drive to disarm the citizens of this country is proof to congress and the people what his intents are. I never thought in my wildest dreams that the people of this country were so uneducated as to fall for the treasonous rhetoric being spewed from mouth. He like any other citizen, which he has renounced by his statements and actions, is not impervious to the supreme law of the country, the Constitution of the United States. His heretical and treasonous philosophies have no place in this country.

      Navy, this is WHY we can’t depend on Congress to enforce the Constitution. They wouldn’t even insist on seeing his documentation when he was running for office. The Democrats are “falling in line” with him and the GOP in the House will not even consider impeachment. So in 2014 when the Democrats take over the House, they have no one to blame for themselves and I will remind them DAILY.

    It is time to ask just how we got so many in-honorable people in Congress that violate their oaths of office so vividly. We have over 70 self proclaimed Communist-Marxist in congress that swore an oath to defend the Constitution from all enemies both foreign and domestic, yet are the enemies within. their actions to limit and remove the protections afforded “We the People” in the Constitution for their own agenda. Just look at the treasonous actions in their support of the Muslim Brotherhood world wide and their inclusion inside the White House, the Office of the Secretary of State and most troubling inside of Homeland Security, which raises the question as to how it was that so soon after their inclusion all of the CIA’s agents in the middle east were named, hunted down and killed blinding our security network to the events of Benghazi and else where, yet still Obama send money and arms to their organizations. After his blatant support during the “Arab Spring” using our troops,equipment and funds to advance the Muslim Brotherhood and still doing so to this day.

    I am not worried about elected officials, themselves, confiscating our weapons. Most of them are wimps, like Obama, who even I could whip in a fist fight. It’s the hundreds of thousands of UNelected people in government agencies (DHS in particular) who would be kicking in our doors. In Germany they wore brown uniforms; here they ware black. Remember, these are the ones who are buying up trillions of rounds of ammo. There’s no voting them out and they don’t hold town-hall meetings.

      However, when you get rid of the “elected” idiots, the unelected heads of the agencies will leave, too. They were nominated by Obama and confirmed by the Senate, so the “elected” idiots are the ones who dropped them on us. The czars and agency heads will run for the hills when the elected misfits are sent packing. However, I don’t think it will be done at the voting booth. We have seen how their constituents just keep on sending the same ones back to D.C., and someone as dangerous as Obama even got a second term. Go figure!

    Do you ever watch a movie, and as you watch you can see all the pieces of the plot laid out for you so clearly that you can easily predict what will happen next? Maybe you don’t know all the details, but you know who the villain will be for example before he is revealed. Maybe you turn to your wife (or whoever) and say “that guy is his dad” or “he did it”, and later when the plot reaches that point she says to you “how did you know?”. Simple, really. A mixture of common sense and reason, combined with having seen many movies like it before.

    Sometimes I feel like I am watching history unfold and I can see what is going to happen. It isn’t hard. You just need to use logic combined with a knowledge of history. Based on these posts, some of you can see it too.

    Obama has more in common with Hugo Chavez than with our Founding Fathers. The end result will be a totalitarian regime enforced via a police state, in which our freedoms are thrown in the trash along with the Consitution. The economy will be destroyed and our prosperity will be gone.

    Unfortunately, when that time comes we won’t be able to take out the DVD and pop it in mail.

    Our government was purposely organized into three non-hereditary branches to avoid the problem that led to the bloody English Civil War of the 1640s where King Charles I and the House of Lords (equivalent to our senate) ignored the restraints of the English Constitution and tried to seize absolute power and the Parliament (our House of Representatives) opposed them. The question the war supposedly settled was that: “no one is above the law and the restrictions of the Constitution.” Yet here we are three and three quarters of a century later faced with the same problem, namely, a president who keeps searching for ways to circumvent the simple ideas of constitutional government so that he may rule by royal edict, but unlike the time of Oliver Cromwell, Obama has found ways to avoid being monetarily controlled by the House. He simply has the FED print more paper, label it money and have the Treasury buy the paper to artificially stimulate buying, but the result is actually taxation by inflation.

    “Constraint” was The rule of the game the creators of the US Constitution were playing. Obama clearly wants to change that rule.
