Napolitano: Guns and the President

By Andrew P. Napolitano

Here is an uncomfortable pop quiz: Who has killed more children, Adam Lanza or Barack Obama? We'll hold off on the answer for a few paragraphs while we look at the state of governmental excess -- including killing -- in America. But you can probably guess the correct answer from the manner in which I have posed the question.

We all know that the sheet anchor of our liberties is the Declaration of Independence. The president himself quoted Thomas Jefferson's most famous line in his inaugural address earlier this week. He recognized that all men and women are created equal and endowed by our Creator with certain inalienable rights and that among these are life, liberty and the pursuit of happiness.

The president would no doubt like to modify the word "created" to read "shall be maintained," since his presidency seems dedicated to keeping us equal, not in terms of equality of rights and opportunity but of outcome. He has dedicated himself to using the coercive power of the federal government to take from those who have and give to those who don't. Under the Constitution, charity is a decision for individuals to make, not the government.

This forced egalitarianism was never the purpose of government in America. When the people in the original 13 states gave up some of their personal liberties to create their state governments so they could perform the services that governments in the West do, and when the states themselves gave up some of their liberties to create the federal government of limited powers to address the issues of nationhood, they never authorized government to impose taxes to transfer wealth to those who lack it or need it.

This may sound harsh, but there is simply no authority in the Constitution for the feds to tax Americans or to borrow money in their names to rebuild private homes in New Orleans or at the Jersey Shore. And there is no moral authority for that, either. If folks want to give money to those whose properties were damaged by natural disasters and lacked adequate insurance coverage, they are free to do so, but nowhere does government have the authority to compel us to do so.

This shows how far we have come from the Constitution the Founders gave us. They "constituted" a government of limited powers, and they did so because they wanted the government to protect our freedoms, since they understood that personal responsibility and freedom -- not government handouts -- are the soundest routes to prosperity. Hence, they limited the government because they knew the lessons of history. And those lessons informed them that often it is the government itself that is the greatest threat to personal freedom.

One hundred years ago, during the Progressive Era, Theodore Roosevelt and Woodrow Wilson turned the concept of limited government on its head. They argued that the Constitution could be disregarded because the federal government possesses unlimited powers to address the people's needs. Barack Obama is their ideological heir. As their heir, he is not only the head of the executive branch of the federal government, but he is also the head of one of the two dominant political parties.

That political party has dedicated itself to making certain killing legal. The Democrats have continually celebrated the abominable decision of the Supreme Court in Roe vs. Wade, issued 40 years ago this week. They have championed abortion for the past 40 years. They have assaulted the greatest and most fundamental of human rights: the right to live. In doing so, they have succeeded in causing the government to permit the killing of more than 50 million American babies in their mothers' wombs in the past 40 years -- for the sake of convenience and sexual activity without consequence, in a manner that is antiseptic and lawful. And no one hears the babies' cries of pain or anguish.

The president himself has more directly killed about 176 children in Pakistan by the use of CIA drones. These drones have been dispatched by him alone -- not pursuant to any congressional declaration of war. At least two of these murdered children were Americans. But since the cameras were kept away, since all of this takes place 10,000 miles from America, and since the survivors are legally and politically helpless, no one here hears the Pakistani children's cries of pain and anguish.

One of the reasons we have the constitutionally guaranteed right to keep and bear arms is to enable us to resist a drone sent to the path of our children by shooting it down, no matter who sent it. But you can't stop a drone with a BB gun. Hence the need for serious firepower in the hands of ordinary Americans -- to give tyrants pause and to stop tyrants when they don't pause. The president wants to use Lanza's horrific slaughter of 20 babies in a public school in Connecticut with a stolen gun as an excuse to restrict the freedoms of all law-abiding gun-owning Americans, any one of whom would have stopped Lanza in a heartbeat with a lawful gun, before the police could, had they been in that school.

Now back to our pop quiz: Who has killed more children, Lanza or Obama? Does a president with blood on his hands have any moral standing to infringe upon the natural right to self-defense of those whose hands are clean? Would you sacrifice your liberty to defend yourself and your children so that the government can kill whom it pleases?

The answers are obvious.

Obama quotes Jefferson correctly, all Men ARE created equal, by God. The problem is when Obamas or CLintons or Pelosi’s try to play God and unequally re-distribute the individual responsibility and accountability for the lives and actions of people created and designed to dwell in a land of INDEPENDENCE , when they re-distribute IN DEPENDENCY to an irresponsible government of corrupt selfish politicians who think they know better how we should live our own lives and spend our own personal property. Just how is that working for you 4 years later and 6 trillion dollars poorer in national Debt?

The new paradigm of power is to attack and destroy the good, the successful, the creative and the exceptional and drag them down to their level of the bottom feedeer of the lowest common denominator of humanity equality. We used to be equally good, motivated, and productive. All they have given us is equal poverty in ideas, morality and purse. Their idea of promoting the general welfare is to have us all enthralled in a welfare system where it is THEY who determine the winners and losers. Promoting welfare and dependency is all they have to offer, since they and their losing ideology of socialism refutes individual success at the cost of collective oppression, propping up of the weak. All they will and have given us is more of what they are,,,,weakness and failure. A disarmed America in the hands of such corruption as men like President Parasite and his horde of social leeches is a recipe for disaster.

I would like to add to the above thought. “All men are created equal” is often quoted out of context and used to justify government enacting socialism. But all men are created equal in certain ways, not in every way. Please consider the full quote. “We hold these truths to be self evident, that all men are created equal. IN THAT they are endowed by their Creator with CERTAIN unalienable rights and among these rights are life, liberty, and the PURSUIT of happiness.”

So although I am sure that those of you who understand the English language can figure out exactly what was being said, for those who have misinterpreted it, either accidentally or on purpose, let’s break it down.

They state that this is truth, (not opinion) and that these truths are self evident, which means they are obvious to anyone with a working brain.

“All men” really means all people, which in our time means women and all races. These rights are human rights and apply to all people in all countries. Many in other countries have these God given rights suppressed by despotic or tyrannical governments, but in our country we set out to limit the power of government so that these rights would be guaranteed.

“are created equal”. To stop reading at this point is a tactic used by those who would somehow use government to use force and coercion of redistribution to achieve some sort of total equality in every way. This would be what Karl Max would have us do. “To each according to his needs” etc. But this interpretation can only lead to being equally poor and equally enslaved.

But if all men were created equal in every way, as some would have us believe, there would be no ugly people. Or we all would be equally intelligent, or we all would be equally talented as artist, or scientists, etc. So all men are not created equal in every way. But a human being they do have “certain” unalienable rights. Unalienable means that there is no denial of this.

“And among these rights are life, liberty, and the pursuit of happiness.” Note that it does not say everyone has a right to be happy, but just the right to pursue happiness. No government can guarantee happiness to all people. Happiness is an individual pursuit. And people have a right to pursue it. This is what that right means, but no one, especially the government can guarantee it. What the Founders were saying is that the government is not to be allowed to interfere with that pursuit.

The pursuit of happiness simply means that every individual has a right to live the best life he can without interference by the government. This does not mean that he can commit crime in that persuit. The punishment of crime is the only valid function of government in this matter.

Obama is using the Newtown school shootings to push his own anti-gun agenda. He is trying to leave law-abiding Americans defenseless, and the only reason that I can see in all of this is not because he is interested in protecting children, but that he is interested in protecting the government FROM the people. Maybe all law abiding gun owners should fore go their semi-automatic firearms and ten bullets. They can then turn around and proclaim their hatred of the Israelis, call them pigs and descendants of apes and qualify for free fighter planes and tanks. Or they can join the drug cartels and get really powerful weapons courtesy of Eric Holder and his Fast and Furious program. It never ceases to amaze me ….the hypocrisy of this administration.

This commentary should be enough to make every single individual cry, and then stand up in opposition to this government, in opposition to the United Nations and about every other world government.

But we have a huge number of folks who have decided their definition of freedom is to sit around and take (through the government) from others .. and when they realize what they have done, it is then too late.

Unless this imposter of a president is stopped NOW (in this term) from infringing any more on our freedoms .. and then start reversing the damage .. this country and this world is done.

There are those that have earned and deserve and truly need through no fault of their own the help of the population and then there are the people that have learned and been taught that they can get something for nothing and they milk the system for everything they can get.

They drop out of school in the 8th grade or earlier, are functional illiterates, are lazy, can never get or hold a decent job because they aren’t qualified to do anything but flip burgers, give nothing back to society and vote for the politician (some times several times) that promises them the most free goodies in return for their votes (see Obama).

They are no better or of use to this nation nor do they deserve what they get any more than the 20 or so million illegal aliens sucking up billions of tax payer dollars and giving little or nothing back.

They have no self esteem and show no shame for their ignorance. In fact some almost seem to take pride or think their stupidity is funny. How many times have we seen a Jay Leno or others go out on the street and ask a random group of people the most simple questions? All that is shown us are those that get the answer wrong or don’t know the answer (showing those that do know the answers are not entertaining and therefore not shown). But there are more than enough that don’t know to be frightening. Like those that call the Marine Corps the Marine corpse and are blissfully unaware of how ignorant they are and the insult the give the Marines.

My gripe is they are dumb as a chicken and think it’s funny that they don’t know who is buried in Grant’s tomb (remember Groucho Marx?) much less have a clue who Grant was or what he did. They just laugh and giggle and go back to doing nothing and blaming everyone and everything but themselves for their failure.

Charity begins at home but at my decision, not the government. Using my money to keep the politicians in their so called jobs is another gripe of mine.

John Wayne got it right when he said “Life is hard. It’s even harder when you’re stupid”.

Agree 100% with both of the above posts.

Obama is the most dangerous and inept pres this country has ever seen, yet he got re-elected, and, when we ask ourselves why, we have to look at the fact that there are more people looking for a free ride than those willing to provide it for them. To get re-elected, all you have to do is pretend that you will give them that free ride… Or actually give it to them, as Obama is doing…

Only those with skin in the game (property owners and tax payers) should be allowed to vote. That will solve the problem of those looking for handouts voting for those promising the handouts.

iamacman, let’s not his years of experience stirring up trouble as a “community organizer”. Let’s forget that there is no correlation between his midnight illegal amnesty of his which tied up the Mexican vote and costs the taxpayers $50,000 per each illegal alien per year and the color of his skin which had nothing to do with getting him 94% of the black vote (AKA get whitey). Add this to the fraud in the recent election (and the first one of his) and throw in the wimps in Congress that refuse to stand up to his unconstitutional activity and are afraid of standing with their oath to the Constitution lest they lose their cushy $174,000/year so called 3 day a week jobs plus perks and fully 100% vested retirement the day they show up for work and a staff to do the work for him while they make the party circuit and you find some of the problems this country is facing. I forgot the 60% voter turnout while 40% lay on the couch and watch the latest American Idol episode. What did I leave out? I’m sure there’s more.

Judge Napolitano’s article is truthful and I am so glad that someone finally came out and stated the FACTS, especially about the 54 million murdered babies. Abortion is true evil, it isn’t about politics or women’s rights. Abortion is evil to the core. The doctors, the patients (women), and the people (president, elected officials, AND the voters) that voted for abortion rights are going to answer to Almighty God. And they will certainly kneel while they are sentenced to an eternal wrath. Killing an unborn defenseless baby is atrocious and beyond comprehension. God does not look the other way. He hates hands that shed innocent blood. God’s wrath is upon this nation and NO ONE will go unpunished for this evil holocaust, this outright slaughter. Evil is not natural, it comes from the pit of hell and from Satan and his followers.

I certainly agree with this article by the judge and this comment on abortion. It makes me sick to my stomach to think of how our beloved America is being destroyed by this evil president and his minions. So many people have turned their backs on God and pushed Him out of America. After Obama finds a way to take our guns he will make a way to run for a 3rd term or just become our dictator without an election. He has to be stopped before this 4 year term is finished or it will be too late.

54 Million babies is hard to even visualize, sorta like a Trillion dollars.
If you take a case based stistical area like New York- Bridgeport, Newark, NY,NJ,CT,PA you get a population count of about 22,085,649 then double it you end up with 44,171,298 which is still short 5,828,702. That should give you an idea of what 54 Million aborted babies is.

The truth is that Obama and the Party of Death has no REAL regard for children, women, the USA or the Constitution….only if they can use them for their own careers. FOX is hiring left-leaning individuals in order to survive because they have been unmercifully attacked for being conservative. In today’s warped society, the liberals have abandoned all reason and judgment and even though liberalism has destroyed every country where it has been put in place, they still insist on taking over America.

FOX along with talk radio have been designated as “hate mongers” and the left is intent on destroying them both because liberals can’t stand the truth and can’t argue facts.

But FOX is making the same mistake we have seen before by attempting “peaceful coexistence”. Liberals don’t want to coexist and they are certainly not peaceful, they are rabid.

Wow! You all equate support for Roe v. Wade in similar terms as shooting children in cold blood. Not an equation of performing the abortion and shooting, but an equation of support for the legal decision of the Supreme Court of the US and the actual pulling the trigger on 6 and 7 year olds.

Is that like my associating an American citizen’s support for Bush II with the illegal deaths of Iraqi’s caused by our illegal unnecessary and ultimately self destructive invasion of Iraq?

Guilt by association is in fact one of the irritants of colonial abuse that led to the First Amendment.

I think this kind of rhetoric is potentially the kind that was identified by many studies across many instances of political and ethnic upheaval and genocide as that which paved the way.

Tone it down. Is Napolitano or any of you prepared to take responsibility for this rhetoric if it leads to some “patriot” trying to make Obama pay for his “tyranny, or for the crime equatable to that of Lanza?

Our Republic is built upon discussion, elections, and respecting the consequences of those elections. Al Gore spoke eloquently after the unheard of and not to be used as a precedent decision of the SCOTUS in 2000. He would not consider any extra-constitutional measures and therefore conceded. I will speak less eloquently…

organize better and beat us at the polls-if you can.

and cutout this violent thread and hyperbolic association of supposed criminal and treasonous guilt for having an opinion you don’t share.

or better yet, keep it up and face the music in the next election as reasonable people see this rhetoric for what it is, damaging, crazy, and completely unreasonable just like the policies of the rightwing.

but God forbid someone takes a pot shot at Obama or any political person. Then who of you will say this speech and the comments found on this thread contributed? Who of you will say that this kind of language undermined democracy by encouraging a shooter?

Abortion is infanticide, whether made legal by the Supreme Court or not. The Supreme Judge, who has created all things, will judge this Nation for the murders of tens of millions of unborn children.

You are one of the “do gooder” liberals who have facilitated the ongoing dismantling of our government through the incremental elimination of our individual freedoms by supporting unlimited government control of our lives through laws and regulation which you think will eventually lead to the holy grail of socialism which is some misguided dream of a utopian society where we have world peace, no crime, and a communal society run by the elistists in government who will define the nature of life in the collective. This idea has historically failed over and over again when eventually the people revolt against the tyrannical elistists/dictators/ Kings or Queens that are forcing their concept of life and values on the citizens of the country. In modern history, Hitler tried it, the USSR tried it, the Chinese communists have dictated this concept but are now moving away from it and It has been a popular model of dictators in Latin America and other countries who go through periodic revolutions in an attempt to break out of it.

Our Founders knew all of this and brilliantly designed a government structure that was based on individual freedom and a government for the people by the people. However, over the years, the socialist/communist element in this country have done a marvelous job of undermining our Constitution and Bill of Rights and now have America on its knees and about to cave to these elements. I hope you are proud of what is happening as your altruistic and overall “social justice” concepts are to blame.

The millions of Americans that have given up their lives to protect our freedoms and national autonomy are probably rolling over in their graves, especially the founders of this country.

Everything in life has a cost and when our government has the power to decide who pays for the cost and who doesn’t have to pay and can take as much as they want from one citizen to give to another who has done nothing to contribute to the welfare of the country, then we have gone too far in our “social justice” and other socially driven policies.

When the voting population has more people “on the take” then those paying the bills, then we have gone over the tipping point and are on our way down the slippery slope to disaster, and this last election basically has proven that is where this country is very close to being.

RIP the America of the past.

How does one respond to a post such as yours defriez2001 ?
I could tell you that you have outclassed yourself by posting here. Misunderstand does not make for good discussion. No one here would compare killing unborn to school children the way you do. Killing of either is terrible. As for Iraq, you know as well as we do that Congress approved of the war in Iraq. We won the war there and provided freedom for Iraqis but the Muslim terrorists came to take over so we had to stay. Your comments about discussions and elections are just what I would expect, just like we expected Obama to say “I won so that means the people want me to do as I please”. As far as the elegant speech of Al Gore…really ? As for the rest of your post…PPfffftttt!

jonoful, look, the reason obama got elected is that “ful’s” like yourself blindly and naively bought his snake oil, and that he appeals to those like yourself who are looking for free ride on the backs of those who actually work for a living and pay taxes – NOT because he is a great man, or a great president, because he is NOT. He is the worst president this nation has ever had to suffer.

Regardless of equations or comparisons, are you saying you agree with the infanticide produced by the right to abort fetuses? If so, you, and all other supporters of the deaths of innocent children, will find yourself in hell one day…

Napolitano’s article states that Democrats support Roe v Wade, and that that is tantamount to supporting the murder of 50 million defenseless infants. That is the truth.

Are you so blind that you will not see?

A quote form the Czech Republic newspaper,Prager Zeitungon, is worth noting:
“The danger to America is not Barack Obama but a citizenry capable of entrusting a man like him with the Presidency. It will be far easier to limit and undo the follies of an Obama presidency than to restore the necessary common sense and good judgment to a depraved electorate willing to have such a man for their president. The problem is much deeper and far more serious than Mr. Obama, who is a mere symptom of what ails America . Blaming the prince of the fools should not blind anyone to the vast confederacy of fools that made him their prince. The Republic can survive a Barack Obama, who is, after all, merely a fool. It is less likely to survive a multitude of fools such as those who made him their president.”

If you don’t know this, and apparently you don’t or choose to ignore facts to fit your blather, you need to get up to date with recent history. FYI, this is not a democracy. Go do some homework, then come back and blame everyone except the ones causing the problems, namely Obama.

As for Abortion, well don’t forget the millions of dollars that it has made for the so called Doctors and others over the years. This rich part of evil has contributed mightily to the election of Clinton and Obozo whose 1st acts of office were to fund abortions overseas.

Regarding the comment by gopluva that certain people who used to speak out against the government are “going left,”: I have stayed very much on top of things since the late 1990′s when I moved to a town filled with illegal immigrants where I couldn’t get a job because I didn’t speak THEIR language! I think that people are just tired of fighting over everything. Elected officials, just like all of us, are branded as racists, bigots, mean spirited, homophobic or some other such name if we speak out. That has always been the case but it is more so than ever since the liberals decided that it was “making history” to elect an unqualified and inept black man as president of the United States.

      bna42:

references please my reading of the various gunwalking programs (gunrunner, fast and furious etc.) indicate that
      1) in both Bush era programs and Obama era programs more guns walked than were recovered.
      2) no arrests were made under the Bush admin, over 600 indictments were unsealed under Obama for the 2 programs (many of which were results of investigative work done under the Bush admin for sure)
      3) The attempt to go after the entire criminal operation not just the small transaction level criminal which brought into the original Gunrunner program of the ATF the DEA, FBI, ICE etc etc made every thing slow way down and complicated the ability of the ATF agents to recover weapons and arrest low level participants.
      4) Many of the transgressions were committed by field level agents operating outside of their instructions

I found no suggestion (albeit from a read-thru that was interrupted many times making for a question mark in my mind as to whether I just missed it) of tracking devices used in the Bush era program and not in the Obama era program.

my source is wikipedia, granted a potentially biased source (depending on the passion and determination of the participants in the edits) See: http://en.wikipedia.org/wiki/ATF_gunwalking_scandal

I am interested in learning more about this disaster and would appreciate sources from you on it. I am not interested in political hyperbole but actual documentation of fact or even well researched opinion w references to follow up on.

At a time that we need more arms to combat rising numbers in criminal activity Obama is trying to reduce the capability of citizens to defend their homes and schools from the growing menace of violence. We must address the killing violence to reduce the acts of copycat violators that are just waiting for opportunities to gain publicity and notoriety by their senseless acts of killing. The facts are that even if we reduce the availability of certain arms and ammunition these killings will continue and infringing on the right to bear arms will never have any effect on stopping these tragedies. It is not the availability of arms that is the problem it is the detiration of our society that is the problem. Our nation has tossed aside the moral responsibility that we inherited from God and our Founding Fathers. We no longer restrain the entertainment industries from molesting the minds of our beloved children and many adults. The need to put the almighty dollar ahead of our children and their future is the priority of Hollywood, Television and Video games that hide behind the First Amendment to protect their immorality. Do you see Obama and his government trying to change the First Amendment to remove the real problem of the killing of our children no we must take away the right to bear certain arms. With the present day I don’t give a dam government’s embracement of violence and killing and the attempt to take away the right to bear arms as the cure to end the killings is the only answer. Sorry Obama you are turning left when you should be turning right.

“Obama is trying to reduce the capability of citizens to defend their homes and schools from the growing menace of violence”

twspears, Obama could not care one wit about defending homes and schools from violence. As a community organizer his job was to stir up violence. The only thing Obama cares about is gaining more control, and since he has done NOTHING to even address the black on black killings and the gang killings, we can safely assume he doesn’t care about the loss of American lives. He still hasn’t explained why he allowed a U.S. ambassador and three others die without help. He still hasn’t explained why U.S. Border Patrol agent Brian Terry died because of Fast & Furious.

Actually the Chicago homicide rate has decreased since Obama Left Chicago. There were 508 murders in 2012. WHen he was active in his community organizing role of divider and redistributor the Homocide rates were 851 in 1990, 927 in 1991, 943 in 1992, 855 in 1993, 931 in 1994, 828 in 1998. Once he got elected to the Senate and left Chicago the homocide rates dropped down to a more managable 450-510 each year from 2004 to the present. Don’t you just love those socialists who spread hate, division and class warfare wherever they go.

I would say that by the end of his second he will have outdone every other president on number of Murders. At todays rate that would be about another 5 million added to the present total.

Tone it down? Elections? You need to extract your cranium from your rectal cavity and get into the real world. We don’t have free elections here, we have rampant fraud. Both political parties have become wings of the same socialist bird. Our “representation” in Washington does not listen to the voice of the people they are supposed to represent, and most of them are traitors, having voted against the Constitution numerous times.

We have an overbearing, tyrannical, self-serving government that tramples the Constitution at every opportunity. What we need here is a revolution, just like 1776 because we are facing the same, and worse, issues our ancestors faced with King George. This illegal government needs to be kicked out and new people put into office. Yes, it is an illegal government because the very moment any of those a$$holes in Washington violated their oath of office, they were unsuited to retain that office, and that is about 99% of them. They need to go. In fact, they should all be hung for treason.

Abortion is no different than walking into an elementary school and blowing away a room full of children. Both are innocent humans, and both are dead. You think it is fine just because the Supreme Court says it is? Oh, they could never be wrong, could they? What about “life, liberty, and the pursuit of happiness” for those dead babies? They are supposed to be protected, not butchered. You, and millions of dumbed down people just like you, are exactly why this country is in the pathetic shape it is in today. But you can’t see that because you are part of the problem.

Have you ever seen a picture of the way some of those abortions are done? The baby is fully formed and capable of feeling pain while it is slashed to pieces inside the mother. Then they take all of the cut up body parts and put them back together outside of the mother to make sure they got it all. Can you imagine how awful that is….like putting a little tiny bloody puzzle together with pieces of arms, legs, toes, a head, a torso. Making a horror like that legal does not make it moral. What kind of a monster can do such a thing for money? It is killing for cash. I hate it. It makes me sick.

What it is going to come down to is simply defending our Liberties any way we can. We can no longer trust either the Republicans or the Democrats to defend our Constitution and our Republic. The Democrats for fifty years now have been slowly moving the country to Communism and rejecting our Constitution. We the People are the only ones who can restore our country to it’s founding. Only when millions of angry citizens of this country come together and storm Washington D.C. will this trashing of our freedoms stop. Why have we, the bravest people in the world and the strongest allowed these 545 politicians to take over our lives? We are 350 million strong, and they take our money, remove our guns, take over our health care, nationalize our companies and we do nothing to stop them. United we Stand, Divided we Fall!
