Malkin: The ACLU's Unholy War on Catholic Hospitals

Ho, ho, ho! Just in time for Christmas, the American Civil Liberties Union has launched a new salvo against people of faith. Even as billions around the world celebrate the birth of Christ, joyless, abortion-obsessed secularists never take a holiday.

On Wednesday, the ACLU sent a letter to federal health officials urging the government to force Catholic hospitals in the U.S. to perform abortions in violation of their core moral commitment to protecting the lives of the unborn. They're counting on sympathetic Obama rationing czar Donald Berwick -- a recess appointee whose radical views on wealth and health redistribution were never vetted by Congress -- to dictate which religious principles hospital operators can and cannot follow.

The ACLU reiterated its call for a federal probe -- read: fishing expedition -- of Catholic hospitals nationwide that refuse to provide "emergency" contraception and abortions to women. In practice, of course, every request for abortion is an "emergency" to the left.

The Catholic Church makes clear that it is morally permissible under certain circumstances to treat directly the cause of the mother's medical condition, even if those efforts unintentionally and indirectly cost the baby's life. But Catholic health providers must never directly trade one life for another.

Civil liberties activists have a particular vendetta against devout Phoenix Catholic Bishop Thomas Olmsted, who recently revoked the Catholic status of a rogue hospital that performed several direct abortions, provided birth control pills and presided over sterilizations against the church's ethical and religious directives for health care. "It would be unfaithful to pretend the institution is still Catholic," Olmsted concluded.

"The dioceses cannot be permitted to dictate who lives and who dies in Catholic-owned hospitals," the ACLU's lawyers fumed in response.

But shall it be left to the ACLU and Obamacare bureaucrats to determine the Catholicity of a Catholic hospital?

And shall it be left to litigious secularists to sabotage the First Amendment rights of religious-based health care entities with impunity?

No.

The ACLU now seeks to unilaterally rewrite a federal emergency medical treatment law passed by Congress in 1986 to mandate that all hospitals provide abortions. But for more than three decades, under both Republican and Democratic administrations, federal law has firmly established strong conscience protections for individual health care providers and hospitals who are reluctant or unwilling to "counsel, suggest, recommend, assist or in any way participate in the performance of abortions or sterilizations contrary to or consistent with" their "religious beliefs or moral convictions."

As the Washington-based Becket Fund, a public interest law firm that defends the free expression of all religious traditions, pointed out to the feds: "The ACLU has no business radically re-defining the meaning of emergency health care,' just as it has no business demanding that religious doctors and nurses violate their faith by performing a procedure they believe is tantamount to murder. Forcing religious hospitals to perform abortions not only undermines this nation's integral commitment to conscience rights, it violates the numerous federal laws that recognize and protect those rights."

According to the Catholic Health Association, Catholic health care facilities form the largest not-for-profit health service sector in the United States -- serving one out of every six patients in America and providing 15 percent of the hospital bed capacity in the country. Moreover, Catholic health care institutions employ about 540,000 full-time workers and 240,000 part-time workers.

If the abortion lobby gets its way, faithful Catholic hospitals and Catholic medical professionals who follow their consciences and adhere to canon law could see their federal funding yanked. And radical social engineers may well force the shutdown of countless Catholic hospitals at a time when Obamacare costs and consequences are already wreaking havoc on the health industry.

Fewer jobs, less access to health care, less freedom and more lives lost: Merry Christmas from the ACLU.

    The American people should demand this organizations name be changed. They are not concerned with civil liberties, or they would not force their views on anyone else’s civil liberties. I have doubts they are American in the true sense of the word. They sound more like some socialist state, like WWII Germany. They should not be called the American Civil Liberties Union. Although they do act like a Union.

    The ACLU is a bunch of Atheist who are trying to push their non belief on everyone else. They need to be sue for harassment and for violating the First Amendment for interfering with peoples religions. They are trying to force people to be unfaithful to their religion. It’s time for this to stop! We need congress to stop flipping the bill for these mean spirited people. These people have a mental problem they absolutely do not know how to live and let live. The ACLU is one of the biggest organizations of BIGOTS in the world they are far worst than the Nazis. They are pure haters, if they all died tomorrow I would celebrate. People like them are bringing our country down.

    To say ‘impeach Obama’ is only to vent ones frustration. Michelle is a ‘voice of reason’ and ACLU is a ‘vice of reason.’ WHEN will those who think they stand for ‘human rights’ but demand a religious faith that founded many health related facilities based upon the human fact of life: One cannot separate ones belief from what one does. We all know ‘separation of church and state’ is not in the Constitution or the bill of rights. The fact is the early immigrants were getting away from just that fact: The Church of England ruled over both secular and religious life and THEY though they were a ‘voice of reason.’ Our founding fathers fought and died to make sure it did not happen again. The ACLU and many others enjoy their ‘freedom’ at the expense of those of any faith. Perhaps when our tax system does a real fact finding study to see the impact of taxing all fairly WITHOUT tax loopholes. Will it happen? I will not hold my breath but I will stand with the ‘Michelle Makin’s’ of this world who do voice against injustice, no matter what robe is being worn.
    2011 will be the prelude to 2012…ACLU and ‘liberation theologists’ are in a sinking ship in the middle of an ocean created by their own ‘righteous ideals.’ ‘Socialism is that ‘opiate of the people’…and it too shall dry up like a grape in the hot sun along with it’s roots.

    To say IMPEACH OBAMA IS NOT JUST FRUSTRATION! This man is a traitor. The only thing he wants is to destroy this nation and replace it whit him as Ruler not leader.     Killing the unborn is a direct conflict with the words of Christ. The Catholic hospitals, keeping faith WITH their faith, do not perform abortions because it is a clear violation of God’s words.
    The ACLU, Planned Parenthood, and all whose agenda includes the planned death of those innocents have, do, and shall continue (to try) killing God’s children.”I knew ye when yet you were in your mother’s womb.”

    I think it is time for a Congressional investigation or ‘probe’ into the ACLU. I would be interested in knowing who is funding this organization, as well as who is really controlling it.
    It appears that the ACLUs persistent and aggressive attacks on any/all perceived violations of ‘church & state’ is nothing more than a thinly veiled attack on Christianity, or at least our Judeo-Christian culture. That being the case, then it is logical to assume that Muslims, possibly not of U.S. citizenship, would be the greatest beneficiaries and a prime suspect as the principal supporter and/or antagonist of the ACLU and its despicable, un-American, activities.

    I wonder if the leader of the Catholic Bishops Conference, Archbishop Dolan is going to speak out as its leader and if he will use what has been defined as “America’s Pulpit”, New York’s Saint Patrick’s Cathedral, by the late Pope John Paul.
    We pray and hope that Archbishop Timothy Dolan will find the courage this 2010 Christmas weekend as the devilish ACLU mounts its attack on humanity. New York is the abortion capital of the United States and where most abortions are performed on minorities.

    The ACLU, from it’s inception in 1920 has always been a leftist, socialist and communist leaning organization. The following is a quote from an internet site:

    Just why do you think that you almost NEVER see ANY conservative group or individual defended? Once in a great while you may see a feeble effort on behalf of the right, but only to “prove” to the brain dead public that their efforts are unbiased. Sadly, much of the public has no idea of the real objectives of this organization.
    It is probably interesting to note that Catholic hospitals are PRIVATE institutions and rarely exist except in large cities where they are certainly not the only medical facility available! No one is forced into these hospitals and if people do not know the moral values of the Catholic church they must have lived their entire lives with their heads in the sand….which (again, sadly) does not surprise me. Our American populace is dumbed-down, undereducated and ignorant beyond belief!

    In the 60′s and 70′s I had to physically fight this scum, that is ruining our country today from DC. The aclu has been fighting against captialist and American values for decades. Who funds the aclu ? czars = communism.

    I love it when liberals and progressives say stupid things! By all means, Mr. Lawyer, let’s not have “dioceses” making life and death decisions. Let’s have government and ACLU lawyers do it instead. Strong arming Catholic hospitals to perform abortions or lose federal funds is just such a decision and in the nastiest of ways.
    I hope the hospitals will stand up to the challenge. I believe they would win any case that went to the Supreme Court.

    The Apache have mescaline rituals as part of their religion. Its still illegal.
    The 7′th Day Adventists think that any medical treatment shows that one does not trust God and it is prohibited. Courts have held that their children may be treated anyway in violation of their religion.
    The mormon religion allows polygamy.
    The Old testament ( in leviticus ) allows for ones daughter to be sold as a slave.
    Some muslim traditions allow for family members who have dishonored the family to be killed.
    It is not an easy question to answer.
    This country does not have a state religion. The religion of each individual is up to that individual. Government officials are not supposed to be religious leaders.
    Our laws are the result of all of our American beliefs being argued and then written in law by legislatures, signed by the president or governors, then tested against the constitution in the courts.

    The Mormon religion does not allow polygamy, that is a misconception believed by many. There are however people, a small minority of sects who do follow that belief. I have a lot of friends who are Mormon and grew up in a town that had a large number of Mormons. a history lesson for you. Most of the original states had their own religion and it was supported by the states. The were abolished by the states because of cost. The reference in the Constitution of a state religion refers to the Republic as a whole, not the states as individuals. As for honor killings they happen every day 365 days a year in Muslim countries. As for selling your daughter, that is directly or true violation of your civil rights in the USA but still occurs in Muslim nations. All of our laws have not been tested in the courts nor or all of them constitutional. God willing that will change. Hate crime laws are an example as they make special laws for different segments of the population and discriminate those not of that segment. Example You mug some you get a prescribed punishment. Commit the same crime against someone gay or a minority you can get a worse punishment. That is a violation of equal protection in Constitution. All crimes are hate crimes, because why would you commit a crime against someone you liked?

    Also, it was the FEDERAL gov’t that unconstitutionally forced the LDS (Mormon) Church to give up polygamy. Whatever you may think of polygamy, the gov’t has no right to dictate to a religion how it can be practiced. I do however think it is OK to forbid religious murder and beatings, these being contrary to a civilized society.
    In the 1970′s the ACLU sued a school district for allowing release time for religious study for credit. This was allowed for ANY religion. It was Utah state law. Of course the anti-religionists won. The ACLU was renamed the Anti-Christians Living in Utah. Where is the ACLU in the TSA sex assault and 4th amendment violations at our airports?

    You mention the ACLU’s proclivity to attack anything Christian. They are focusing on one faction of society based upon their desire to eradicate any mention of Jesus Christ from this nation. Why are they not targeting Muslims, as well? After all, Muslims habitually are mentioning their founder Muhammad and their God, Allah. Buddhists have their God, Buddah…and the ACLU does not say anything. Inuits in Alaska worship another God. Why the fixation on Christianity? Does not that bias invalidate their position? And, in effect, show discrimination against one societal group? That is a crime.
    I have heard before that the operations of the ACLU are in violation of RICO LAWS. (Racketeering and Corrupt Organizations Act) What they are doing is in direct correlation with groups like the KKK’s attack on Blacks. Their involvement is subversive to the peace and diversity acceptance that Democrats have been demanding for decades. How do you spell Hypocrisy???

    Archbishop Dolan was head of the divison which includes the Milwaukee diocese and was very well liked there. He was brought in to clean up the molestation mess that Rembert Weakland created and by all accounts he’s a hard worker and very charismatic.
    In regards to Mormons being polygamous: It’s been against their rules for many years but now that DADT has been passed it won’t be long before same sex marriage will be passed and then it can’t help but follow that polygamy, polyandry and polyamory will follow because they’re basing their case on civil rights. You can’t deny polygamists, polyandrists or polyamorists the same rights you allow to same sex couples. After all, they can’t help who they fall in love with, as one judge said.

    Edward, dude, you’re forgetting that the lost aren’t damned until they die. When they do, if they haven’t accepted Jesus as savior, then they WILL go to Hell. Those poor, unfortunate “doctors” who decide they want to kill the unborn babies are indeed going to have to answer for the sin of murder. If they are Christians, God will be having a few words for them concerning their choice of professions. I doubt, though, their consciences will allow them to commit murder like that.

    I agree that Hate Crimes are a sop for the left.
    They take something (like assault, or murder, etc.) and make it even more illegal.
    It is a criminalization of thought and that should be against the first amendment.
    The democrat republican game is largely an argument about issues that don’t really matter to the Plutocrat elite.
    On issues that really matter to the Plutocrat Oligarchs the Dems and the Pubs are identical.
